May 10, 2016 1 Volume 10 I Issue 9 Zoning Bulletin <br />Zoning News from Around the <br />Nation <br />MARYLAND <br />Wicomico County is considering zoning legislation that would establish <br />"broader setbacks as well as buffers" for poultry houses. Under current zon- <br />ing, poultry houses must be at least 100 ft. away from residential dwellings. <br />Draft legislation, aimed at addressing "emissions" from poultry houses, <br />would would create setbacks of 400 ft. in A-1 agricultural areas, and a min- <br />imum of 500 ft. in designated growth areas. The draft legislation would also <br />require "a minimum of four rows of trees" as a buffer from poultry houses <br />"for aesthetic reasons." <br />Source: WMDT; www.wmdt.com <br />NEW YORK <br />New York City is contemplating, legislation that would empower the <br />City's Department of Transportation ("DOT") to exact control over the <br />city's 69 pedestrian plazas. The legislation reportedly calls on the DOT to <br />establish New York City Police Depaihnent-enforced "plaza -specific rules" <br />to regulate the "use of, and activities within, an individual pedestrian plaza." <br />Under the proposed legislation, costumed characters who do business in <br />Times Square could, for example, be relegated to designated zones within <br />Times Square. Such businesses reportedly oppose the legislation, alleging <br />that it would impede their right to freedom of speech, and could negatively <br />impact their business. <br />Source: Gothamist; htty://nothamist.com <br />TENNESSEE <br />In late March, the state Senate approved a bill that would "prohibit cities <br />from adopting a policy that would mandate affordable housing to be <br />included in new residential projects." Proponents of preventing mandatory <br />inclusionary zoning say it is aimed at "the inflated pricing and structure" <br />with a goal of letting "the free market continue to work" to "enact an incen- <br />tive -based that's free market inclusionary zoning policy."
