SECTION 300.16. CONDITIONAL USE PERMIT STANDARDS FOR RESIDENTIAL DISTRICTS <br />2. General Standards. <br />No conditional use permit shall be granted unless the city council determines that all of the following <br />standards will be met: <br />a) the use is consistent with the intent of this ordinance; <br />b) the use is consistent with the goals, policies and objectives of the comprehensive plan; <br />c) the use does not have an undue adverse impact on governmental facilities, utilities, services or <br />existing or proposed improvements; and <br />d) the use does not have an undue adverse impact on the public health, safety or welfare. <br />EDINA prohibits the sale of goods from portable buildings (Sec. 36-1262 and Sec. 36-618), with the <br />exception of the temporary sale of evergreen products in residential districts (Sec. 36-439). The City <br />expressly prohibits the sale of fireworks out of temporary structures/stands (Sec. 18-246). <br />SEC. 36-1262. - CERTAIN SALES PROHIBITED. (Under General requirements applicable to all districts <br />except as otherwise stated) <br />(a) Except as provided in article V of chapter 12 [Peddlers and Solicitors], the sale of goods or <br />merchandise from a motor vehicle, trailer, tent or other temporary or portable building is prohibited <br />in all districts. <br />SEC. 36-618.- SPECIAL REQUIREMENTS (Under Commercial District) <br />(10) Outdoor sales, tent sales and trailer sales prohibited. Except for the dispensing of motor fuels and <br />the use of drive -through facilities permitted by this chapter, all sales of products and merchandise, and <br />dispensing of services, shall be conducted from within the confines of a permanent building totally <br />enclosed by four walls and a roof. The sale of products and merchandise, and the dispensing of services, <br />from a motor vehicle, trailer, tent or other temporary structure or shelter, or outside of a permanent <br />building as described in this subsection, is prohibited. <br />SEC. 36-439. — SPECIAL REQUIREMENTS (Under SF residential) <br />(6) Temporary retail sales of evergreen products from conditional use properties. The city manager may <br />grant a permit for temporary retail sales of evergreen products, if: <br />a. The owner of the property or other nonprofit group approved by the owner conducts the <br />sale. <br />b. The duration of the sale does not exceed 45 consecutive days and does not start before <br />November 15 in any year. <br />
