Votin~ NO: Nome. <br /> <br />Authorize Budget A,~ndment For Police Department: <br /> <br />Finance Officer Noel Graczyk stated that the Police Department needs to <br />amend it's 1987 Police Protection Budget by $3300 for the purchase of the <br />current f~X)P~ software upgrade and the purchase of One replacement light <br />bar to be installed on the new squad car. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca to approve <br />Resolution %87-53 ~ the 1987 General Fund Budget. (Please refer to <br />resolution file for Resolution #87-53). <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Co~~rs Sorteberg, COx, <br />DeLuca and Pearson. Voting No: Nor~. <br /> <br />~ Flintwood II Develo_u~ent A~_reement: <br /> <br />Mr. Goodrich stated that the City and Flintwood Venture Company entered <br />into a Develolmmnt ~greement dated June 14, 1985. ~he primary purpose of <br />this Development Agreement is to insure the payment of the special <br />assessments levied against the lots in the plat. Flintwood Venture sold 33 <br />lots to Barnett Builders and would like to be relieved of its obligations <br />relating to the 33 lots; Barnett Builders does not want to accept Flintwood <br />Venture Company's liability relating to the remainder of the undeveloped <br />lots in the plat. Mr. Goodrich rec~~ that Flintwood Venture assign <br />it's rights and obligations ~der the Development A~re~ment relating to the <br />33 lots to Barnett Builders, Inc. Barnett will then enter into a <br />Develolmmnt Agreement with the City based on the existing Development <br />Agreement but relating only to the 33 lots. <br /> <br />Motion by Gouncilm~m~er Sorteberg and seconded by Co~cilm~nber DeLuca to: <br /> <br />1) <br /> <br />authorize an amendment to the original Develolmmnt A~re~ment <br />dated June 14, 1985 between the City and Flintwo~d Develolmm. nt <br />C~ny, whereby Fl intwood Venture Om~mny will assign all of <br />it's rights and obligations ~der said Develou~ent ~re~ment <br />relating to the foll(~ing described 33 lots: Lots 10 and 12-21 of <br />Block 3; Lots 1-8, 13-17 and 20-28 of Block 4; all in Flintwood <br /> <br />2) <br /> <br />Barnett Builders, Inc. will accept the said assignment relating to <br />the 33 lots described in It~ (1) above and agree to he bound by <br />the applicable terms of the Development Agreement including the <br />posting of escrow for the special assessment balance in a form <br />acceptable to the City Attorney. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca and Pearson. Voting No: Nor~.
