PUBLICHEARIIYG CASE #: ~ <br /> <br />REQUEST FOR A VARIANCE TO STREET RIGHT OF WAY WIDTH REQUIREMENTS FOR <br />THE RAMSEY TOWN CENTER 4TM ADDITION; <br /> CASE OF RAMSEY TOWN CENTER LLC <br /> By: Patrick Trudgeon, AICP, Assistant Community Development Director <br /> <br />Background: <br /> <br />As part or' the site plan review of the NAU Insurance Building located in the plat of Ramsey Town <br />Center 4th Addition, City Staff requested that the proposed building be shifted two feet north from the <br />south k)t line. This was to accommodate the need of the City to have adequate space in order to properly <br />maintain the sidewalk and streetscape along Sunwood Drive. Due to site constraints, Staff stated that the <br />City would be willing to accept a lesser right of way for 145th Ave. and advised Ramsey Town Center <br />LLC to apply [bra variance from City Code. <br /> <br />The variance request is to dedicate 58 feet of right-of~way for a street (145th Ave.) that will be created as <br />part of the Ramsey Town Center 4th Addition (RTC 4ih) plat. The City Council approved the preliminary <br />plat of RTC 4'~' on June 22, 2004 contingent on the development receiving a variance to street right-of- <br />way widths. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />e) <br /> <br />g) <br /> <br />Site location map <br />Preliminary Plat of Ramsey Town Center 4~' Addition <br />Proposed findings of fact <br />Proposed variance for approval <br />Proposed variance for denial <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject property of <br />tile request ~br variance and public hearing. <br /> <br />Observations: <br /> <br />City Code requires dedication of 60 feet of right-of-way as part of new subdivisions. After review of the <br />streetscape plans fbr Sunwood Drive by the City's Public Works department, it was determined that 11 <br />feet will be needed fi'om back of'curb to the property line in order to allow for snow removal equipment <br />to safely operate between the buildings and the boulevard trees. This results in a need to shift the <br />proposed building along Sunwood Drive two feet to the north. Staff has discussed this issue with the <br />Applicant and they have agreed to move the building and provide a 2 foot drainage and utility easement <br />along the southern property line. The applicant has reduced the size of the building as much as possible <br />I'or tile site and tile building materials have been ordered. <br /> <br />Due to the necessity ~br shifting the building on the plat, a 58-foot right-of~way is being requested. As <br />originally presented as part of the Ramsey Town Center 4'h Addition plat, 145"~ Ave. was a 60-foot right- <br />ot'~way and had (fi'om south to no~-th) 5 feet of sidewalk, 7 feet of boulevard, 36 feet of road surface, and <br />12 l"eet or' boulevard. If granted, tile variance will allow for 58 feet of right-of-way.
