boulevard, 36 feet of road surface, and 10 feet of boulevard. The lesser boulevard (10 feet versus 12 feet) on the north side of 145~' Ave. is adjacent to South Park. The need for a variance was discussed with the Planning Commission at their June 17~h Special Meeting. Recommendation: Staff recommends approval of the variance requests due to the following reasons: 1) since the final streetscape design along Sunwood Drive was agreed to after the Applicant had submitted plans, the Applicant is unable to shrink the building as they have indicated that they cannot reduce the size of the building any further and still meet the needs of their operations; 2) the lesser right-of-way is advantageous to the City, in that it allows for a greater width of the sidewalk along Sunwood Drive for proper maintenance and 3) the impact of the lesser right-of-way for 145~ Ave. is mitigated by several factors: a) the traveled road surface of 145~t~ Ave will stay the same (36 feet wide) as it would with a 60- foot right-of-way; b) the 145'~' Ave. right-of-way will still contain a sidewalk and adequate boulevard for snow storage; and c) the lesser right-of-way will.be deducted from the boulevard located on the north side of the right-of-way which is adjacent to South Park. Staff has included a resolution for both denial and approval for the Board of Adjustment's consideration. Board Action: Motion to adopt Resolution #04-07- adopting Findings of Fact #__ relating to a request for a variance from street right-of-way width requirements. -and- Motion to approve the request for a variance to street right-of-way width requirements as part of the Ramsey Town Center 4~h Addition and adopt Resolution #04-07- declaring terms of same.
