During this field review, <br />they noticed the following: <br /> <br />1) <br /> <br />17665 Argon Street N.W.; Mr. Edwin C. Potter; <br />grading and structure violation. Zt appears <br />that the only landscaping Mr. Potter has com- <br />pleted is sodding. No shrubs or trees have <br />been planted to screen the stairway from the <br />river. Legally, it could be argued that stair- <br />ways are not a permitted use; however, riparian <br />owners have some right of access from their <br />property to the water. Along the Rum River the <br />slopes are mostly sand and are extremely erodi- <br />ble. The use of foot trails for access tends <br />to increase the erosion problems, hence a stair- <br />way, if designed and constructed properly, would <br />be in the better interest to the river environment. <br />Although Ramsey's Ordinance No. 81-4 does not <br />specifically address stairways, nor are stairways <br />exempted from being structures, there are other <br />sections of the ordinance which could apply. <br />Section 170.078.2 addresses placement of struc- <br />tures on any slope greater than 12% and states <br />that such structures must be screened. Section <br />170.070.21 deals with grading and filling, and <br />states that a grading and filling permit cannot <br />be issued unless grading and filling is performed <br />in a manner which minimizes earthmoving, erosion, <br />tree clearing, and the destruction of natural <br /> <br />EQUAL OPPORTUNITY Ek'Z,.OYER <br /> <br /> <br />
