I <br /> i <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />i <br /> <br />CTITY OF RAMSgY <br /> <br />AGREEMENT TO GUARANTEE COMPLIANCE <br />WITH DEVELOPMENT CONDITIONS ESTABLISHED <br />BY THE CITY OF RAMSEY <br /> <br />This agreement, made and entered into this day of November, 1983, by and <br />between the City of Ramsey, hereinafter referred to as "City', and Mr. Henry Birchem, <br />hereinafter referred to as "Applicant% <br /> <br /> WHEREAS, the applicant has requested authorization to subdivide by metes <br />and bounds; and . <br /> <br /> WHEREAS, the Ramsey Planning and Zoning Commission has recommended <br />granting said metes.and bounds subdivision. <br /> <br />NOW THEREFORE, IT IS AGREED BY AND BETWEEN THE PARTIES HERETO, <br />as follows: <br /> <br /> 1) That the applicant shall provide the necessary easements for a cul-de-sac <br />at the east end of 177th Avenue NW where it adjoins the applicant's west property <br />line. <br /> <br /> Z) That the applicant shall upgrade said cul-de-sac to a standard as established <br />by the City Council. <br /> <br /> 3) That the applicant shall provide the City of Ramsey with a quit claim deed <br />granting the necessary easements for the street right-of-way. <br /> <br /> 4) That the applicant shall provide the City of Ramsey with a certificate <br />of survey showing the cul-de-sac and the properties to be subdivided. <br /> <br /> 5) That no further subdivision of the applicant's property will be permitted <br />without platting. <br /> <br /> 6) That the cul-de-sac shall be brought to the established standard prior to <br />August 15, 1984. <br /> <br /> 7) That a park fee, as established by Ordinance ~83-13 shaU be assessed. <br /> <br /> 8) That failure to comply with all the terms of this agreement shall render <br />this agreement null and void and stop the issuance of a building permit. <br /> <br />APPLICANT: <br />Date: <br /> <br />CITY OF RAMSEY: <br /> <br />Date: By: <br /> <br />Henry Birchem <br /> <br />It's City Adm!ni-~crator/Clerk <br /> <br /> <br />
