Board Member Van Scoy asked if proof of the easement was provided when the other two <br />approvals took place. <br /> <br />Associate Planner Geisler stated it was not provided because they never came in for a building <br />permit. <br /> <br />Chairperson Nixt asked if proof of the easement was not a condition of the previous variance. <br /> <br />Associate Planner Geisler stated she was not sure. <br /> <br />Public Hearing <br /> <br />Kelly I-temp indicated the easement was done with the purchase of the property. <br /> <br />Chairperson Nixt asked if it is a transferable right. <br /> <br />Mr. Hemp stated he is confused about the variance being tied to requesting a building permit. <br /> <br />Chairperson Nixt stated there is a requirement to have a minimum amount of frontage on a public <br />road before you can build. <br /> <br />Mr. Hemp indicated he thought the variance was granting access to the property, so he does not <br />see why it would be tied to a building permit. <br /> <br />Board Member Johnson advised you can buy any property you want, but may need a variance to <br />use it. <br /> <br />Chairperson Nixt stated they would have 12 months to build if this is approved, and asked if that <br />was what the Hemps were planning to do. <br /> <br />Mr. Hemp indicated they would build within a year. <br /> <br />Mr. Hemp indicated they may be buying some adjacent property, which may affect where the <br />house sits. <br /> <br />Chairperson Nixt advised there are separate issues with that, including combining lots, and asked <br />Mr. Hemp to work with Staff on those issues. He suggested that if the Hemps are not going to <br />start building right away the Planning Commission could table the request now and combine the <br />needs so it does not have to be re-noticed, and would not require an additional fee. <br /> <br />The Hemps agreed to have the request tabled. <br /> <br />Chairperson Nixt noted the Planning Commission sounds like they are inclined to grant the <br />request being asked for this evening, but make no claims about approving any additional <br />requests. <br /> <br />Board of Adjustment/June 3, 2004 <br /> Page 4 of 5 <br /> <br /> <br />
