o <br /> <br />o <br /> <br />homestead and one new buildable lot that will be allowed for development with a single <br />family dwelling. <br /> <br />That the Permittees are herein granted permission to construct a private driveway that will <br />access 174th Avenue N.W. The Permittees herein agree that at least the first 60 feet of <br />driveway extending off the cul-de-sac bulb will be constructed of bituminous to prevent the <br />deposit of earth materials onto the paved portion of 174th caused by traffic to and from the <br />property. <br /> <br />That in the event it is determined to be necessary, the City herein agrees to grant the <br />Permittees an easement for access purposes within any unimproved dedicated right-of-way <br />for 174th Avenue lying between the temporary cul-de-sac bulb and the east boundary of the <br />Subject Property. <br /> <br />This variance to plat the Subject Property and construct a home on the new buildable lot <br />created shall automatically expire if it is not initiated by March 11, 2005. Recording of the <br />plat and application for a building permit to construct a dwelling on the new lot created shall <br />constitute initiation. The Permittee may petition for an extension of time in which to <br />complete the variance. Such extension shall be requested in writing and filed with the City at <br />least 30 days before the expiration of the original variance. <br /> <br />The new buildable lot created on the Subject Property is eligible for building permits for one <br />dwelling unit and related accessory structures in accordance with City Code and no further <br />building permits for additional residential structures will be issued until such time as the <br />Subject Property is replatted in accordance with City Code and access is provided via a <br />public road improved to City standards. <br /> <br />The Permittees shall make a reasonable effort to locate the residential structure and any <br />accessory buildings constructed on the Subject Property so as not to interfere with the orderly <br />resubdivision of the Subject Property and extension of 174th Avenue, at some point in the <br />future, and by accepting this variance acknowledge that not doing so may adversely impact <br />the ability of the Subject property to be subdivided in the future. <br /> <br />That the Permittees herein agree that the new lot created at the westerly terminus of 174th <br />Avenue will share, as an equal partner, in road maintenance costs assessed to the property <br />owners in Fox Ridge. This agreement to share in Fox Ridge road maintenance costs shall be <br />in force umil such time as this lot is re-subdivided and serviced with its own publicly <br />dedicated and improved streets. <br /> <br />The Permittees agree that this variance shall be recorded in the office of the Anoka County <br />Recorder. <br /> <br />The Permittees shall be responsible for all City costs incurred in administering and enforcing <br />this variance. <br /> <br />RESOLUTION/404-03-068 <br /> Page 2 of 4 <br /> <br /> <br />
