Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-05-105 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0673 RELATING TO A REQUEST <br />FROM STEPHEN AND NILA DEHEN FOR A VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE <br /> <br /> WHEREAS, Stephen and Nila Dehen, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 (Accessory Structures) of the Ramsey City <br />Code to coustruct an accessory structure nearer the front property line than the principal structure <br />on the property generally known as 14720 Bowers Drive NW and legally described as follows: <br /> <br />l Jot 8, Bower's Mississippi Acres, Anoka County, Minnesota <br /> <br />(the "Subject Property"). <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicants appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on May 6, 2004, and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-1 MUSA and is approximately 1 acre in size. <br /> <br />3. That the Subject Property is surrounded by properties also zoned R-1 MUSA. <br /> <br />That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure on lots less <br />than two (2) acres in size. <br /> <br />That Section 9.21.07 (Critical River Overlay District Development Standards) of City Code <br />establishes a structure setback of 200 feet from the Ordinary High Water (OHW) mark of <br />thc Mississippi River or thirty-five (35) feet from the bluff line, whichever is greater. <br /> <br />That the principal structure on the Subject Property is located approximately 74 feet fi'om <br />thc fi'ont property line and 190 feet from the OHW mark of the Mississippi River. The <br />principal structure is legal nonconforming. <br /> <br />That the Applicants are proposing to construct a 26' x 30' accessory structure on the <br />Subject Property that would be approximately 10 feet from the front property line and about <br />260 feet from the OHW mark of the Mississippi River. <br /> <br /> <br />
