10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />That the total square footage of accessory structures on the Subject Property, including this <br />proposed structure, would not exceed the maximum square footage allowed in City Code. <br /> <br />That thc location of the well prevents the Applicants from moving the structure directly <br />west (closer to the home) to achieve a greater front yard setback. <br /> <br />That if the proposed structure were moved southwest of the proposed location, a mature <br />maple and a clump of mature river birches would need to be removed and a mature oak tree <br />would be severely impacted. <br /> <br />That the proposed location of the accessory structure is adjacent to the existing driveway in <br />an area clear of vegetation (there is an extension of the asphalt driveway which is where the <br />structure is being proposed). <br /> <br />That ii' the accessory structure were to be constructed in the rear yard, it would intensify the <br />existing encroachment on the 200 foot setback from the Mississippi River resulting from <br />the location of the principal structure. <br /> <br />That similar variances have been granted in the R-1 MUSA District in the City of Ramsey <br />generally, and specifically on Bowers Drive. <br /> <br />That the Mississippi River setback requirement imposes a hardship on the Subject Property <br />that is not applicable to other lands in the same district. <br /> <br />That, ii' granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />That, i £ granted, the variance will not have the effect of allowing a use that is prohibited in <br />the applicable zoning district. <br /> <br />That, if granted, the variance will not increase the congestion on the public street. <br /> <br />That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br /> <br />That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br /> <br />That, if granted, the variance requested is not the minimum variance necessary to <br />accomplish the intended purpose of the Applicants. <br /> <br />That thc unique circumstances on the Subject Property do not result from the actions of the <br />Applicants. <br /> <br />RESOLUTION #04-05-105 <br /> Page 2 of 3 <br /> <br /> <br />
