P.O..Anoka, Minnesota 55303 ~e: Develeument Requirements - 1983 Urban Service Area Dear Mr. Schnelle: You have asked for our opinion concerning the applica- tion of Section 170.039D cf the City Code to an exten- sion o~ trunk ~;ater and s~wer mains in the City's 1953 Urkan Service Area As we understand the situation, A, the ewner of a ~arcel in the Area began proceedings fo= platting and sukdivision of the parcel but has abandoned them for the time beinc. A has indicated to the City, however, that'he intends to plat and develop the property, that this development will be facilitated by the con- struction of the trunks, and that he is willing to petition the City to have 100% of the.cost of the trunks through the.parcel specifically assessed under ~inn. Stat., Chapter 429. B, the owner of an adjoining tract to the east wishes to proceed with development and is prepared to comply with tke Stace. The construction of the trunks across.A"s parcel is essen- tial to the orderly develop:,lent of the entire Urban Service Area. In this factual setting you have asked whether A must comply with the Stage I development requirements of Section 170.039D of the ordinance. In our judgement he does not. First, it appears that the section applies to persons "engaged in the development of lands and properties", and A see~s not to be presently so engaged and is not requesting the City to participate in the construction of or payment for the Stage I imprcve- ments.
