A has indicated to the City, however, <br />that'he intends to plat and develop the property, that <br />this development will be facilitated by the con- <br />struction of the trunks, and that he is willing to <br />petition the City to have 100% of the.cost of the <br />trunks through the.parcel specifically assessed under <br />~inn. Stat., Chapter 429. B, the owner of an adjoining <br />tract to the east wishes to proceed with development <br />and is prepared to comply with tke Stace. I Escrow <br />recuirements cf the ordinance, enter into the required <br />development contract, with the City, and otherwise <br />follow all the necessary steps for development. The <br />construction of the trunks across.A"s parcel is essen- <br />tial to the orderly develop:,lent of the entire Urban <br />Service Area. <br /> <br />In this factual setting you have asked whether A must <br />comply with the Stage I development requirements of <br />Section 170.039D of the ordinance. In our judgement he <br />does not. First, it appears that the section applies <br />to persons "engaged in the development of lands and <br />properties", and A see~s not to be presently so engaged <br />and is not requesting the City to participate in the <br />construction of or payment for the Stage I imprcve- <br />ments.
