Mr. Lloyd $chnelle <br />City of Ramsey <br />Page 2 <br /> <br />ordinance and Section II B of the Comprehensive Plan is <br />to insure the orderly and ecenomically sound develop- <br />ment of Service Areas and to insist on A's compliance <br />with the ordinance section might, and probably would, <br />jeopardize the installation of the trunks which are <br />essential to B's development as well as that of other <br />parcels in the Service District. We doubt that the <br />ordinance intends suck a result, and it is clear from <br />the public utilities element of tke Plan (p. 71) that <br />t~'.e City contemplates ju3t such trunk installations <br />pending develo~.ment as are proposed for A's parcel. <br />The fact tkat A is willing to have the parcel assessed <br />for the trunks will stimulate the development of the <br />parcel and enhance the financial soundness of the <br />entire project which furthers the overall objections of <br />the Plan element, since the Plan contemplates the City <br />ncrmally picking up costs for oversizing ef trunks <br />pending development. <br /> <br />in su~:ary, we view the situation as ne different from <br />~ne in which the City had determined, for wkatever <br />reason, to construct the Pro~ect.and where A had never <br />thcucht of future development. In such a case we see <br />no reason why the City could not proceed as planned and <br />tkere would be no question as to the a~plic&Dility of <br />the ordinance section to A. When A decided to develop <br />the c. rdinance would come into effect and the necassary <br />escrows, davelcpment contracts, plat approval and <br />assessrent procedures would be required. <br /> <br />~e hope tkis response satisfactorily answers your <br />question.
