No. 47. This is proposed to be constructed as a <br />MSA street. Also, Wa¢o Street has to be extended to the City <br />property as shown on the preliminary plat and constructed to T.H. <br />No. 47. <br /> <br />A grading permit will have to be issued by the City prior to any <br />grading. Grading will have to be done in accordance with the <br />grading plan approved by DNR and City. Engineer. The developer <br />will also be required to comply with all City Codes concerning <br />grading. <br /> <br />In review of lot dimensions in relation to City Code 170.01511, <br />Lot 5, Block 1, Lots 8 and 9, Block 2, Lots 2, 3, 16, 17, 18 and <br />19, Block 3, Lot 8, Block 4, Lots 2, 3, 4, 6, 8, 9, 15, 16, and <br />17, Block 5, Lot 2, Block 7 and Lot 5, Block 8 do not meet the <br />minimum lot depth of 135 feet. The lots are in conformance with <br />City Code 170.07 Scenic River Ordinance, therefore, we would <br />recommend the City grant a variance to the lot depth. <br /> <br />In review of the scenic River Ordinance Article 170.075oll states <br />that public roads are Conditional Uses. However, Article <br />170.0710.3 states that "a conditional use permit is not required <br />for minor public streets which are intended to serve primarily as <br />an access to abutting properties." The council should make a <br />finding to the effect that the streets in River's Bend are "minor <br />public streets" as defined by sectiOn 170.0710.3. <br /> <br />DNR has reviewed the plat and found 'it Consistent with the Scenic <br />River Ordinance. However, a permit must be acquired from DNR for <br />construction of Waco Street in a wetland. <br /> <br />As previously stated, outlots should be added to abutting lots <br />unless the developer can show acCeptable plans for their future <br />use. <br /> <br />The developer must enter into an agreement with the City in which <br />he agrees to complete the grading, pay for the assessments for <br />sewer, water, streets and storm sewer, complete the Stage II <br />construction requirements and comply with all other articles in <br />the City Code. <br /> <br />Plans and specifications for construction of the required <br />utilities should be ordered contingent on the developer posting <br />the required escrow. <br /> <br /> <br />
