AUTHORIZATION OF BID ON MUNICIPAL WELL <br /> <br />NO. 1): <br /> <br />The following is hereby' submitted on the above listed items: <br /> <br /> /' a) Acceptance of legal opinion regarding City Ordinance #84-4 from City bonding <br />attorney dated July 30, 1984 - Enclosure (D~.-d) contains the following documents <br />for Council information: <br /> <br />1) Legal opinion from Mr. Kennedy, City bonding <br /> ~' 1984 <br />Z) Excerpt from City Ordinance #84-4, Paragraph 39D <br />3) Excerpt of City map <br /> <br />attorney, dated July 30, <br /> <br />As you will note on the City map, the trunk sanitary sewer has to go through the <br />Holmes property to serve the subtrunk sanitary sewer which will serve the River's <br />Bend plat and the Raudio land. Consequently, we have one developer involved which <br />is River's Bend who will be committed to the requirements of the above stated City <br />ordinance. 'The legal opinion points out that Holmes and Raudio are not committed <br />to escrow funds but only to assessments for the improvement until they develop their <br />land. <br /> <br />Council Action: Your action on item (a) will be only to note that you have reviewed <br />and understand the contents of the legal opinion in regards to the City Code. <br /> <br /> b) First reading of Ordinance #84-6 to amend Chapter 170.06 of the City Code <br />entitled "Flood Plain Management" - Enclosure (DZ-e) contains the following documents <br />for your review in regards to this case: <br /> <br /> 1) Proposed Ordinance #84-5 which has been posted on the City Hall bulI~ <br /> board for general public to review <br /> Z) Map showing area concerned ;: .',': <br /> 3) DNR's letter approving the rezoning <br /> <br />Council Action: No action is required, as you can only receive the above ordinance <br />now and then you can adopt it at your next meeting on August 28, 1984.
