the ground water, there would be protection to the extent <br />possible by State and Federal laws. <br /> <br />Doug H~mm - Inquired if Waste Management can be held accountable <br />for the existing site now? <br /> <br />Mr. LeFevere - Stated that currently the parent corporation cannot <br />be held accountable; the subsidiary can. <br /> <br />Brenda Bauerkemper - Referred to June 25, 1984 public hearing <br />minutes and comments by Erika Sitz regarding cases where the <br />parent company has been traced for remedial action. <br /> <br />LeFevere - Stated he cannot respond to Ms. Sitz' remarks; that <br />he doesn't know the circumstances of PCA getting back to the <br />parent corporation. <br /> <br />Roger Shaski - 7020 153rd Avenue - There is no guarantee that <br />Waste Management and parent company, State and Federal agencies <br />will always be solvent; it could come back to the citizens. <br /> <br />Mr. LeFevere - If all that did happen, the City would have to <br />take care of it's own water supply system and the burden would <br />be on the City. Local companies will be solvent as long as <br />the company is in operation. The permit provides considerably <br />more protection. <br /> <br />Mr. Shaski - What if problems occur 15 years after Waste <br />Management is through with the site? <br /> <br />Mr. LeFevere - If there is no assistance from Federal, State <br />and County government, or any other governmental agency; if <br />Waste Management local and international are no longer solvent; <br />if Anoka is no longer solvent~ then it would fall back on the <br />citizens of Rmmsey. <br /> <br />Larry Phillips - 6640 153rd Lane NW - Referred to June 25, 1984 <br />public hearing minutes, page 14, Erika Sitz co~,ents. <br /> <br />Chairman Peterson - Stated that Ms. Sitz'comments were her_~ <br />opinions and does not make it law. <br /> <br />Larry Phillips - Anoka should be stuck with any and future <br />liabilities resulting from the landfill. <br /> <br />Chairman Peterson inquired if Ramsey has any liabilities if <br />nothing changes. <br /> <br />Mr. LeFevere - Cities have been held liable for negligent <br />inspection. This would be a fairly remote possibility as <br />R~msey does not monitor or regulate the site. Another <br />potential liability has to do with the fact that Ramsey currently <br />regards itself as having property rights in this property <br />under the contract with the City of Anoka. If this package goes <br />through, it is possible that the City will never have legal <br />title.
