I If the deferment is granted, the City Clerk shall notify the <br />· Anoka County Auditor who shall record a notice thereof with the <br /> Anoka County Recorder's office, which notice shall set forth the <br /> amount of the assessment, plus the interest rate and period of <br />I time during which interest shall accrue. <br /> <br /> Subdivision 3. Interest on Deferred Assessment. Interest <br /> I on the deferred assessment shall accrue at the same rate as on <br /> non-deferred assessments. Interest shall cease to accrue on the <br /> date when the assessment would have been paid in full had it not <br />I been deferred. The maximum amount due on the assessment will <br /> then be the original assessment plus interest accrued during the <br /> original assessment term. <br />I Subdivision 4. Termination Right. to Deferred Pa}rment. <br /> of <br /> The option to defer the payment of special assessments shall <br /> terminate and all amounts accumulated plus applicable interest <br />I shall become due upon the occurrence of any of the following <br /> events: (a) the death of the owner, provided that the spouse is <br /> otherwise not eligible for the benefits of this Section; (b) the <br />I sale, transfer or subdivision of the property or any part <br /> thereof; (c) if the property should for any reason lose its <br /> homestead status; or (d) if for any reason the City Council <br />I shall determine that there would be no hardship to require <br /> immediate or partial payment. <br /> <br />i Subdivision 5. Standards and Guidelines for I)eterminins the <br /> Existence of a Hardship and a Disability. <br /> <br />I <br />I <br />I <br /> <br />A. A hardship shall be deemed prima facie to exist when all of <br />the following apply: <br /> <br />a. The annual gross income of the applicant according to <br />his most recent federal income tax return plus his tax-exempt <br />income does not exceed $12,000.00. If no such return was <br />made, the Clerk shall require the applicant to submit other <br />pertinent information to show that this qualification is <br />met. <br /> <br />i b. The special assessments to be deferred exceed $300.00. <br /> Notwithstanding the foregoing provisions of this subdivision,. <br /> the City Council may consider exceptional and unusual <br />I circumstances pertaining to an applicant not covered by the <br /> above standards; but any determination shall be made in a <br /> nondiscriminatory manner and shall not give the applicant an <br />I unreasonable preference or advantage over other applicants. <br /> B. Retirement by reason of permanent and total disability shall <br /> <br />I be deemed prima facta to exist when the applicant presents a <br /> sworn affidavit by two (2) licensed medical doctors attesting <br /> <br /> that the applicant is unable to be gainfully employed because of <br />i a permanent and total disability. <br /> <br /> <br />
