I I I i maintained in accord with the inspection procedures as prescribed in Chapter 150.015, and if such system is found to be a health hazard as defined in this section, the zoning officer shall give to the c~ner of such system written notice stating the defects thereof. This notice may require the owner or person in charge of the systems to within seven (7) days com~mnce either the required repairs and improvements or corrective actions to bring the system into compliance with this chapter. All stroh work shall be completed within ninety (90) days from the date of the notice, unless otherwise stipulated by the pl,mbing inspector. If necessary, such notice may also prohibit forthwith any further discharge into the system until all defects have been abated and approved by the pl~m~ing inspector. 2. Proper service of such notice s~all be by personal service upon the owner of record, if he shall be found within the Ramsey municipal l{m~ts. If he is not found within the Ramsey municipal limits, such service may be made upon said owner by registered mail or certified mail, provided t~at if such notice is by registered mail or certified mail, the designated period within which said owner or person in charge is required to comply with the order of the plumbing inspector shall begin as of the date he receives such notice. 3. At the time of service of notice as above described, the plashing inspector shall also by mail forward a copy of said notice to the City Council. 150.018C CRITERIA EOR HEAL~H HAZARD Criteria for determirmtion that a system is a health hazard shall include, but not be limited to, the following: The appearance of on-site disposal system effluent into surface waters at any tim~, or on the ground surface continuously or intermittently over a period of fifteen (15) consecutive days; The exposure for more than seventy-two (72) hours of an on- site system or part thereof that is in use; A system in which the level of effluent is sufficiently close to the ground surface to result in offensive odors. 150.018D RIGHT%OREPAIR In case the owner shall fail, neglect, or refuse to comply with the notice to repair or rehabilitate or abate as described in Chapter 150.018B above, the city council may order the owner of the building prosecuted as a violator of the provisions of this ordinance and may order the pl~m~ing inspector to proceed with the work specified in such notice. A statement of the cost of such work shall be transmitted to the city council, who shall cause the same to be paid and levied as a special assessment against the property. 150.018E O0STS Costs incurred under Section 150.018D shall be paid out of the city's general f~nd. Such costs shall be charged to the owner of the premises, involved as special assessment on the land on which the bailding or structure is located, and shall be collected in the manner provided for special assessments.
