! <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />150. 019 ADMINISTRATION <br /> <br />150.019A ENEOR~ <br /> <br />Any person who commits any of the following acts or violates any of the <br />provisions of this ordinance which prescribe that certain action is unlawful <br />shall be guilty of a misdemeanor, and upon conviction thereof shall be fined in <br />an amount not to exceed $100 for each violation. Each day that unlawful <br />activity continues shall constitute a separate violation: <br /> <br />a. Disposes of sewage or installs or renovates an individual sewage <br /> treatmmnt system without first having received a permit as provided <br /> · herein. <br />b. Installs or renovates an individual sewage treatment system or <br /> discharges sewage in a manner which involves the knowing and material <br /> variation from the terms and specifications contained in the <br /> application or permit. <br />c. Violates the terms of an order issued pursuant to the provisions <br /> contained herein. <br />d. Conducts the business of or engages in activities described in Chapter <br /> 150.015F herein without first braving obtained the required license. <br />e. Willfully fails to conduct the testing or cleaning obligations <br /> established pursuant hereto or unlawfully refuses a right of entry to <br /> the adm{nistrator when requisite notice has been provided. <br /> <br />The ph~nbing inspector may by written order suspend or revoke any disposal or <br />system permit when he has information indicating that the permit has been issued <br />in error or on the basis of incorrect or inadequate information or that work is <br />not being performed in compliance with this ordinance or the provisions of <br />any permit issued hereto. <br /> <br />Cease and Desist Order. The administrator may issue and order to the owner or <br />occupant of any premises utilizing an individaul sewage treatvm~nt system to <br />cease and desist the use of any system which is operating in a manner creating <br />substantial hazard to the public, health, safety, or welfare or which has not <br />been repaired in accordance with the provisions of any order issued pursuant to <br />Chapter 150.018 herein. A noticed public hearing shall be held within 14 days <br />following the issuance of such an order to determine whether the order should be <br />continued in force and effect. <br /> <br />The plumbing inspector may cause to be assessed against the property on which an <br />individual sewage treat~nt system is located the cost of proper closure, <br />restoration, and cleanup of pollution occurring as a result of a system <br />failure. Upon certification by the accountant of the cost incurred, the City <br />Administrator shall cause the cleanup assessmmnt to be levied against the <br />property on which the system is located. <br /> <br />150.019B LIABILITY <br /> <br />~he plumbing inspector or any employee charged with the enforcement of this <br />Chapter, acting in good faith and without m~lice for the city in the discharge <br /> <br />- 31 - <br /> <br /> <br />
