REQUEST TO DELETE PROPERTY FROM THE RUM RIVER FLOODWAY BY FILLING AND REZONING SAID PROPERTY ACCORDINGLY; CASE OF MR. ART RAUDIO: I I I I I I I I I I I I I Mr. Art Raudio, representing City Wide Properties, Inc., is requesting consideration of removing about ten acres from the Rum River floodway and rezoning said property accordingly. His requset at this point would require the City to submit a resolution supporting the request to the DNR so they can calculate the effects on the river staging. Filling over approximately six acres would be required. In a meeting with Mr. John Stein of the DNR, we were informed that this would be acceptable if it did not increase the staging (or flood level) by more than six inches and did not restrict the channel flow. The Planning and Zoning Commission held a public hearing at their meeting of February 7, 1984 and recommended adoption of a resolution requesting the DNR to do the study. However, they tabled action on the rezoning until such time as they have the DNR's recommendations. Mr. Raudio is requesting the following considerations as a part of this request: a) Adoption of Resolution #84- b) Rezoning of the subject property contingent upon DNR approval c) Grading permits to complete the necessary grading We would recommend that you adopt this resolution and direct staff to forward said resolution to the DNR. However, we would recommend that you table action on the rezoning and grading permits until you have received the DNR findings and the Planning and Zoning Commission has acted on the rezoning.
