PAUL, MINNESOTA 55155 <br /> PHONE: (612) 296-8202 <br /> <br />REIMBURSEMENT AGREEMENT FOR AIRPORT CONSULTANT SERVICES <br /> <br />I <br />I <br /> <br />Municipality City of Ramsey <br />State Project No. 0205-01 <br />Federal Project No. ---- <br />Contract No. 1651 <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> This Agreement is between the State of Minnesota, hereafter referred to as State, by and through its Commissioner <br />of Transportation, hereafter referred to as Commissioner, and the City of R~msey , <br /> (City, County. Municipality, Alrl3ort Commission) <br />hereafter referred to as Municipality. Hakanson Anderson <br /> WHEREAS, the Municipality has retained Assoc. ~ Incorporated to provide consultant services for <br /> preparing a comprehensive airport master plan for the Gateway North Industrial <br /> Airport in the City of RamseV. . <br />hereafter services; <br /> <br /> WHEREAS, the Municipality's airport has been designated by the Commissioner as part of the state airways system; <br />and <br /> <br /> § § 360.015 and 360.305 and is willing to financially assist the <br /> <br /> WHEREAS, the State is authorized by Minn. Stat. <br />Municipality in the above services; <br /> <br /> NOW THEREFORE, it is agreed as follows: <br /> <br /> 1. <br /> <br />The Municipality's estimated cost for these services is $ 40 ~ 400 <br />total cost for these services are Federal --- %, State <br />pal __ 20 __% and the State'~ obligation shall not exceed $ <br />event Federal reimbursement becomes available or is increased for these services, the State shall be entitled to <br />withhold from such funds an amount not to exceed the State share under this Agreement. No funds are Com- <br />mitred under this Agreement until they are encumbered by the Minnesota Department of Finance. <br /> <br />The Municipality and its consultant shall: <br />Conduct the services in accordance with the work program' indicated in the approved agreement for services on <br />file with the Commissioner. <br /> <br />Obtain prior approval from the State for any modifications or changes in the scope of work. <br /> <br />Make regular progress reports and present them to the State, along with documentation as to th.e elements and <br />phases of the services prior to requesting reimbursement on partial estimates of cost. <br /> <br />Confer on a regular basis with the State to coordinate the design and development of the project. <br /> <br />If the Municipality fails to comply with the terms of this Agreement, the State may terminate it upon <br />30 days written notice to the Municipality, and the Municipality will return;upon demand to the State, the <br />amounts received hereunder, together with interest at 6% per annum from the date of payment. <br /> <br />The Municipality presently has available sufficient unencumbered funds to pay for its share of these services and <br />it shall be responsible in the execution of this Agreement that all provisions of its municipal charter and appli- <br />cable state and federal laws have been strictly followed. <br /> <br />The Municipality will maintain its records and provide such information on request of the State so as to permit <br />the State, the Legislative Auditor, or the State Auditor to examine those books, records, and accounting <br />procedures and practices of the Municipality relevant to this contract pursuant to Minnesota Statutes ~ 7.6.095. <br /> <br />The MuniciPality shall save and hold harmless the State from any claims, liabilities, or damages including <br />but not limited to its costs and attorneys' fees arising out of the airport design and development financed <br />hereunder or out of the agreement between the Municipality and its consultant. <br /> <br /> · The proportionate shares of <br /> 80 %, and Munici- <br />32~320 ..
