TERMS AND CONDITIONS <br /> <br />GENERAL PROVISIONS <br /> <br />Honeywell's obhgation under this agreement is to provide a quality ~nsta!!ahon or sen'ice as provided in this agreement. <br /> <br />The chent will provide reasonable means of access to all equipment covered by this agreement. Honeywell will be free to <br />start and stop all primary equipment incidental to the operation of the mechanical system(s) as arranged with the chent's <br />representabve. <br /> <br />All Jnst,3Jlation and non-emergency services under this agreement will be performed during the normal working hours of <br />Honeywell's normal working days. <br /> <br />The client will promptly notih) Honeywell of any malfunction in the system(s) which comes to the client's attention. <br />All payments for ongoing service will be made in advance of the period during which the service is provided. <br /> <br />If an emergency service call is made at the client's request, and inspection does not reveal any defect for which Honeywell <br />is liable, the client will be liable for regular charges prevailing for such service. <br /> <br />In addition to the price set forth, the client ag rees to pay any present and future taxes or any other governmental charges <br />now or hereafter imposed by existing or future laws with respect to transfer, u. _se, ownership, or possession of the <br />equipment or services covered by this agreement. <br /> <br />The client agrees that, during the period of this agreement, the client or the client's employees and agents will not, without <br />prior written permission by Honeywell, disclose any manuals or data relative to this agreement to any organization or <br />individual, and will treat all information provided as proprietary. <br /> <br />Should the system being installed under the terms and conditions of this agreement use Honeywell's Power Line Carrier <br />Communications as its transmission system, it is understood that no other signaling device will be used for the <br />transmission of data through the existing network of the client's building power wiring, since such use could interfere with <br />the system's ability to transmit data. <br /> <br />LIMITATION OF LIABILITY <br /> <br />It is agreed that, in providing the system or services included in this agreement, Honeywell is not an insurer, and does not <br />guarantee that no damage or injury to persons or property will occur. <br /> <br />Honeywell's responsibility for damage or injury to persons or property that may be caused by or arise through furnishing, <br />installing, maintaining, servicing, monitoring, or performing any obligation under the agreement will be limited only to <br />losses proximately caused by Honeywell's negligence. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, <br />CONSEQUENTIAL, SPECIAL, SPECULATIVE, OR REMOTE DAMAGES. <br /> <br />Honeywell will not be liable for damages caused by delay in installation or interrupted service due to fire, flood, corrosive <br />substances in the air, strike, lockout, dispute with workmen, inability to obtain material or services, commotion, war, act of <br />God, or any other cause beyond Honeywell's reasonable control. <br /> <br /> <br />
