THOMAS HOLKER:

Mr. Thomas Holker is requesting the above described variances for a 13+ acre
parcel of land he wishes to subdivide into two lots. The property is located on
Sunfish Lake Blvd. NW just south of County Road #5.

Mr. Holker did request a subdivision of this property at your June meeting of
1983. His request was for three lots but it was the consensus of the Commission
that only two lots would be acceptable.

This property, at one time, was approved for subdivision as a part of the Highpoint
plat but was not included.

We have discussed this subdivision with the Metropolitan Council and they have
informed us that with findings that would include the fact that the property
was at one time a part of a larger proposed subdivision, we could grant a variance
to the density requirements. The question of platting or subdividing by metes
and bounds must still be decided.

The Planning and Zoning Commission reviewed this request and recommended
granting a variance to the density requirements of the ordinance. However,
they did not recommend granting a variance to the subdivision code to subdivide
by metes and bounds.

The following items are included as enclosure (D3-b) for your consideration in
this matter:

a) Applicant's letter dated April 11, 1984
b) Planning and Zoning Commission meeting minutes dated June 7, 1983
c) Proposed findings of fact
d) Planning and Zoning Commission meeting minutes dated May 1, 1984
e) Letter to Mr. Thomas Holker dated May 4, 1984

Council Action: Your action will be to approve/disapprove/amend the proposed
findings of fact and approve/disapprove of Mr. Holker's request.
