! <br />! <br /> <br />(j) <br /> <br />If City expressly disapproves by resolution of the <br />City Council any change of rates or introductory <br /> <br />! <br />m <br /> <br />rates of any new or additional service, either City <br />or Grantee may initiate binding arbitration pursuant <br />to Minnesota Statutes except as delineated below. <br /> <br />(k) <br /> <br />The parties shall, within 15 days of City's express <br />disapproval by resolution of the City Council of <br /> <br />any rate increase, appoint one arbitrator each who <br />is experienced and knowledgeable in the evaluation <br />and analysis of cable rate and charge changes. <br /> <br />(1) <br /> <br />Arbitrators shall each agree upon the selection of <br />a third arbitrator, similarly qualified, within 15 <br />days after appointment of the second arbitrator. <br />Within 15 days after appointment of all arbitrators <br />and upon ten days written notice to parties, the <br /> <br />(m) <br /> <br />arbitrators shall commence a hearing on the rate <br />change proposed by Grantee. <br /> <br />The hearing shall be recorded and may be <br /> <br />transcribed at the request and expense of either <br />party. All hearing proceedings, debates and <br />deliberations shall be open to the public, City, <br />and Grantee and at such times and places as <br />contained in the notice or as thereafter publicly <br /> <br />(n) <br /> <br />stated in the order to adjourn. <br /> <br />The arbitration panel shall be required to approve, <br />reject or modify the rate change proposed'by <br /> <br />0065:3/14/84 <br /> <br />Grantee according to the standards established in <br />this franchise. <br /> <br /> <br />
