CC Regular Session 4. 10. <br />Meeting Date: 10/11/2016 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #16-10-194 Approving an Easement Encroachment Agreement for the Property Located at 6850 <br />Sunwood Drive NW: Case of Anderson-Dahlen <br />Purpose/Background: <br />In reviewing revised plans for the Anderson-Dahlen building expansion, located at 6850 Sunwood Drive NW (the <br />"Subject Property"), it was determined that an Easement Encroachment Agreement (the "Agreement") would be <br />necessary. The need for the Agreement is to address portions of a public storm sewer line that will be or already is <br />underneath pavement. <br />Notification: <br />Notification is not required when considering an Encroachment Agreement. <br />Observations/Alternatives: <br />There are two public storm sewer lines that traverse portions of the Subject Property. One takes drainage from <br />Sunwood Drive to the adjacent regional pond. The second is an overflow outlet from the regional pond. Both lines <br />either are or will be covered with pavement and curb/gutter. Should maintenance ever be necessary on this <br />infrastructure, it will require the disruption of the parking lot and maneuvering space. The Agreement simply <br />solidifies that the City retains its right to maintain this infrastructure and any impacts to the site improvements <br />would be the Subject Property owner's responsibility to repair. <br />The request has been reviewed by the City's Engineering Division and they find this approach to be acceptable. <br />Funding Source: <br />All costs associated with this request are the Applicant's responsibility. <br />Recommendation: <br />Staff recommends adopting Resolution #16-10-194 approving an Encroachment Agreement for existing and new <br />pavement and curb/gutter over existing public storm sewer lines on the Subject Property. <br />Action: <br />Motion to adopt Resolution #16-10-194 approving an Easement Encroachment Agreement on the Subject Property. <br />Site Location Map <br />DRAFT Encroachment Agreement <br />Resolution #16-10-194 <br />Attachments <br />Form Review <br />Inbox <br />Reviewed By Date <br />
