Anoka County Contract No. C0004758 JOINT POWERS AGREEMENT BETWEEN ANOKA COUNTY AND THE CITY OF RAMSEY FOR THE MISSISSIPPI RIVER TRAIL PROJECT (SP 002-090-002) This Joint Powers Agreement (JPA) is made and entered into this day of September, 2016, by and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue North, Anoka, Minnesota 55303, hereinafter referred to as the "County," and the City of Ramsey, a Minnesota municipal corporation, 7550 Sunwood Dr. NW, Ramsey, Minnesota 55303, hereinafter referred to as the "City." WITNESSETH WHEREAS, Minn. Stat. §471.59 authorizes political subdivisions of the State to enter into joint powers agreements for the joint exercise of powers common to each. WHEREAS, access to parks, trails, and recreation areas are essential to the quality of life, health, and welfare of the City, the County, and the region; and WHEREAS, it is in the financial interest of each jurisdiction to collaborate on regional and local trail facilities for the benefit of local, County, and Metropolitan area residents; and WHEREAS, the County is proposing to construct segments of the Mississippi River Trail (the "Trail") including certain trail connections which will impact the City's trail easement located across a portion of property adjacent to the Mississippi West Regional Park; and WHEREAS, the County will be allowed access to the City's trail easement for purposes of the design, engineering, bidding and construction of the Trail, and the City will continue its regular maintenance activities of the trail easement, as set forth in this JPA; NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED AS FOLLOWS: I. PURPOSE The parties have joined together for the purpose of constructing proposed trail segments within the City of Ramsey to the Mississippi River Trail ("Project"). The proposed trail segments and connections are depicted in Exhibit A, which is attached hereto and incorporated herein. Further, it is the intent of this JPA to provide for the planning, engineering, and capital costs necessary to complete the Project and provide for the operation and maintenance of the resulting trails.
