FIRST IMPRESSIONS CONTRACTING

October 9, 198#

Honorable Mayor and Ci~ty Council
City of Ramsey
15133 Nowthen Blvd. N.W.
Ramsey Minn. 33303

Re: Liquidated Damages
Parks Improvement Project #83-17

Gentlemen:

Tfs letter is to advise you that Firs1
of the assetment o£ liquidated damag
ak ye noted contract awarded to our

Fi ;t, there are many questions that

1. How was the amount determined?
asseted was the additional
between the two conl facto

2. Were the engineering costs
completion date?
orders included?

!
I
I
I

I

This letter is to advise you that First Impressions Contracting is in strong opposition
of the assetment o£ liquidated damages in the amount of $826.37 asseted on the
above noted contract awarded to our Firm.

First, there are many questions that [ feel need to be addressed.

[t is my understanding, that the amount
engineering costs of approximately $1632.00 split
between the two contractors, North Star Drilling, [nc. and our Firm.

due to the project running beyond the scheduled
Was the costs for the designing and processing of change

Were the liquidated damages asseted against the party truly at fault in the
delay? Our Firm had installed nearly the entire system except the controller
which was delivered to Mr Raatika's office and of course, the change orders
by the end of May.

Our Firm stayed in frequent communications with Mr. Raatika regarding the
progress or ]ack of progress. It was not until our Firm was involved in three
other large jobs that the site was ready for completion. Even at that time there
was no pump start switch installed. Finally our Firm install this in order to
get the job finaled.

Under the circumstances the delay in the completion of this job also cost us
time and .money in having to continue to monitor a job that should have been
finaled months before. If after reviewing our position, you still feel the liquidated
damages asseted were appropriate, [ will persue the matter with my attorney.

II

I
I
I

Your review and consideration in this matter would be greatly appreciated.

Respectfully Yours,.

Congt'an~ce
Owner
2525 Nevod~ Ave. No., Suife 200 · Golden V~lley, MN 55427 · (612) 542-9510
