Community Development Director Gladhill requested the Commission now review the lot depth
standards variance.
Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to adopt Resolution #16-
10-189 - Approving Findings of Fact #0970 for Variance to Lot Depth Standards and Resolution
#16-10-190 - Approving Issuance of Variance to Lot Depth Standards for Lot 16, Block 2 and
Lot 1, Block 1.
Further discussion
Community Development Director Gladhill requested the Commission make a determination on
Lots 3 and 4.
Friendly Amendment: Motion by Commission Bauer, seconded by Commissioner VanScoy to
recommend Lots 3 and 4 be combined into one lot.
Commissioner Nosan did not agree with the lot combination. She asked if the 36 foot homes
would be out of place compared to the surrounding 50-foot-deep homes.
Mr. Bona explained that not every home within the neighborhood would be 50 feet deep. He did
not believe there would be a noticeable difference in the homes from the street. He reported 36-
foot-deep homes were being built in Brookfield 6th at this time. He stated again, for the record,
that he would be willing to have covenants approved with the Council to ensure the homes on
Lots 3 and 4 were no more than 36 feet deep.
Commissioner Bauer believed these options were reasonable; however, the City would have no
way of enforcing this requirement. For this reason, he supported the combination of Lots 3 and
4.
Mr. Bona suggested that the home depth for Lots 3 and 4 be written into the Developer's
Agreement.
Community Development Director Gladhill explained that he could only enforce City Code
within the Development Agreement. He reported the City had no authority to dictate what
housing style was placed on these lots. He believed that the Commission could not rely on a
covenant but rather to support the combination of Lots 3 and 4.
Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, VanScoy, and Brauer.
Voting No: Andrusko and Nosan. Absent: None.
Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to recommend that City
Council adopt Resolution #16-10-188 - Approving Brookfield 8th Addition Preliminary Plat,
combining Lots 3 and 4 into a single lot.
Planning Commission/October 6, 2016
