RONALD DANNER: <br /> <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Mr. Ronald Danner of Danner's Cabinet Shop, Inc., is requesting a Board of <br />Adjustment variance to place a structure Z0 feet from the rear property line. <br />Section 170.013D(Z) of the City Code requires said setback to be 35 feet. Due <br />to the nature of the adjoining properties, we don't feel granting this variance <br />will pose any real problems. We do, however, have another problem inasmuch <br />as manufacturing in a B-I, Business, zone is a non-conforming use. Section <br />170.014A of the City Code states that a non-conforming use may be continued, <br />but may not be extended, expanded or changed to a conforming use except as <br />permitted by the Board of Adjustment. Accordingly, it shall be necessary for <br />the Board of Adjustment to consider the expansion of Mr. Danner's non-conforming <br />use as well as the location of the structure. <br /> <br />The following items are included as enclosure (D3-a) for your consideration in <br />this matter: <br /> <br />a) Applicant's application <br />b) Sketch of proposed structure location <br />c) Area location map <br />d) Public hearing notice <br />e) List of properties notified <br />f) Building Official's letter to Mr. Danner <br />g) Proposed findings of fact <br />Council Action: Your action will be to approve/disapprove/amend the proposed <br />findings of fact as well as approve/disapprove of this request. The following <br />proposed motions are hereby submitted for your consideration: <br /> <br />Motion by and seconded by to adopt/deny/amend <br />the findings of fact for Mr. Ronald Danner's request of the Board of Adjustment <br />to place a structure Z0 feet from the rear property line and to expand his <br />non-conforming use by adding 5,1Z0 square feet to his structure. <br /> <br />Motion carried.
