m <br />m <br /> <br /> i <br />:1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> I <br /> ! <br /> I <br /> I <br /> <br />If an animal is not so claimed, WBAC may <br />dtspose of said antmal in a humane manner, <br />pursuant to ~tnnesota Statute Section 35.71, <br />Subd. 3. <br /> <br />That all impoundment fees shall be returned to <br />CITY/TOWN by WBAC. <br /> <br />That WBAC shall provide euthanasia service to <br />CITY/TOWN at a charge of $7.00 per animal. Said <br />service shall be administered by qualified <br />personnel and the disposal of animal carcasses <br />shall be performed as required by Minnesota <br />Statute Section 35.82, Subd. 2 (al. <br /> <br />'8. <br /> <br />That WBAC shall assume all liability for all <br />harm to persons, animals and property due to its <br />negligence or the negligence of its employees or <br />agents arising from the performance of this <br />contract, and agrees to defend any legal actions <br />arising therefrom· WBAC shall hold CITY/TOWN <br />harmless and provide CITY/TOWN with proof of <br />public liability coverage, in the amount of at <br />least $200,000 per each claimant and $600,000 <br />for each occurrence, covering the performance of <br />this contract. Further, WBAC will furnish the <br />CITY/TOWN a certificate of insurance evidencing <br />statutory Workers' Compensation coverage for all <br />WBAC employees. - <br /> <br />That during the duration of this contract WBAC <br />shall not, within the State of Mlnnnesota, <br />discriminate against any employee or applicant <br />for employment because of race, color, creed, <br />national origin, or ancestry and shall include a <br />similar provision in all subcontracts entered <br />into for the performance hereof, this paragraph <br />being to comply with the provisions of Minnesota <br />Statute Section 181.59. <br /> <br />10. <br /> <br />That WBAC shall keep accurate and detailed <br />records of the impounding and disposition of all <br />animals picked up in CITY/TOWN and furnish <br />monthly reports to CITY/TOWN as to the services <br />performed during the month. <br /> <br /> AND CITY/TOWN, in consideration of said covenants and <br />agreements of WBAC hereinbefore contained, hereby covenants with WBAC <br />that CITY/TOWN will obtain Animal Control Service from WBAC pursuant <br />to the following provisions: <br /> <br />11. <br /> <br />That CITY/TOWN shall pay to WBAC the sum of <br />$31.50 per month for Animal Control Service. <br /> <br /> <br />
