(This is a new section that was added prior to 8.04.01 Procedures, which will now change the numerical sequence of this 8.04) Al:,uilin~ }roperzy O}n~ers This phrase refers to the embers of reel property in the City of Ramsey, which parcels abut upon a proposed local improvement and benefit from the improvement. b) Non-Abutting Property Owners ~ This phrase refers to the owners of any real property in the City of Ramsey which does not abut, but which may receive a benefit from a specific local improvement, c) Property Owner ~ Refers collectively to the individual, individuals, entity or entities noted as the fee owner, or in the case of land being purchased under contract for deed, to the vendee thereof, according to the then current records of the Anoka County Auditor, of each parcel of land which is recognized as a separate tax parcel by the Anoka County Auditor. d) Benefit - Refers to an actual increase in the fair market value of a parcel of realty as the result of a local improvement, Ail benefited property shall be defined before the public hearing on the improvement is conducted. e) Local Improvement - Refers to any improvement to any publicly owned facility, including but not limited to streets, alleys, sidewalks, sanitary sewer lines, city water services, storm sewers~ drainage facilities, street lighting, utilities, parks, buildings or other public property, which improvement is carried out, in whole or in part, under the authority of the City of Ramsey. f) Benefited Property Owners - Includes both abutting and non-abutting property owners who benefit from an improvement. Section 8.04.02. Procedures.(Formerly 8.04.01 of the most recent charter draft.) Ali. improvements to be paid for by special assessments against the benefited property shall be instituted by either, (1) the petition of at least thirty- five percent in numberof the abutting property owners together with a resolution adopted by an affirmative vote of the majority of all of the council CC/January 26, 1984 Page 5 of 8
