Exhibit B <br />October 24, 2016 <br />CITY OF RAMSEY <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />NOTICE OF OBJECTION PRESENTED IN RESPONSE TO THE <br />NOTICE OF PUBLIC HEARING AND ASSESSMENT FOR <br />CITY IMPROVEMENT PROJECT 16-00; DIVISION C <br />ANDRIE STREET AND 164th LANE RECONSTRUCTION <br />MEETING TO BE HELD OCTOBER 25, 2016 <br />REGARDING PROPOSAL AND POSSIBLE <br />ADOPTION OF PROPOSED SPECIAL ASSESSMENTS <br />Dear Mayor and Councilmembers of the City of Ramsey: <br />I am writing to object to the proposed special assessment on my property, property identification <br />number 183225120015, in the amount of $6,636.40 for the above referenced project. The <br />reconstruction of this road was necessary due to the decision of the City of Ramsey to not <br />properly maintain this road which resulted in the premature deterioration of it. In addition, the <br />amount of the assessment exceeds the benefit to the property. <br />I appreciate the efforts of the City to work with the residents to construct a road consistent with <br />the desires of the neighborhood. I recognize that the current administration was not in place at <br />the time of the original construction of the road and likely not the ones that made all of the <br />maintenance decisions over the life of the road. However, the city government, as an entity, not <br />the residents, is responsible for its decisions and actions both past and present. Unfortunately, <br />the current administration is now dealing with this situation. <br />Purpose of Special Assessments <br />According to the Special Assessment Toolkit from the League of Minnesota Cities, special <br />assessments are a charge imposed on properties for a particular improvement that benefits the <br />owners of those selected properties. The most typical use is to pay for infrastructure in <br />undeveloped areas of a city, particularly when the city is converting new tracts of land to urban <br />or residential use. Special assessments frequently pay for opening and surfacing (paving <br />unpaved) streets; installing utility lines and constructing curbs, gutters, and sidewalks. Special <br />assessments reflect the influence of a specific local improvement on the value of selected <br />property. <br />No matter what method the city uses to establish the amount of the assessment, the real measure <br />of benefit is the increase in the market value of the land because of the improvement. In recent <br />unpublished opinions, the appellate courts have routinely upheld decisions that went against the <br />city because the district court found a lack of adequate evidence of a market value increase equal <br />
