The road authority must enter into an agreement <br />with the railroad company for the proposed railroad grade <br />crossing. If an agreement is reached, the road authority <br />would contact MnDOT to obtain a Commissioner's Order for the <br />crossing. At that time, MnDOT would recommend the type of <br />warning device required at the crossing. <br /> <br />If an agreement is not reached between the road authority and <br />the railroad company, the road authority would request that <br />MnDOT conduct a Public Hearing at which time the road <br />authority would be responsible for demonstrating a need for <br />the railroad crossing.
