You will note that Mr. Alsdorf is very <br />upset with how he perceives the City handled his zoning complaint <br />dealir~g with Welsh Auto Body and Mr. Steven Welsh. Some background <br />ir~formatior, or, this for you is as follows: As you know, both of these <br />businesses ~re located in the City's business district on the south <br />side of Highway #10 NW. Eoon Marketing constructed a new facility <br />at their site in 1984 and 1985. Mr. Welsh then moved in and commenced <br />somewhat of ar~ auto body repair business and brought in numerous junk <br />cars and auto parts, etc. Auto repair is a permitted use in this <br />district. His yard then became visually unpleasant and Econ Market- <br />ir, g called the City complaining about this problem. We in turn con- <br />tacted Mr. Welsh or, numerous ocassions to clean up the site and tried <br />to get him ir, to dc, a site plan, tried to get him to build a building, <br />etc., none of which worked. On September 19, 1985, we commenced a <br />lawsuit agair,st Mr. Welsh which was scheduled to go to court in mid- <br />December. Mr. Welsh then came in again and said he would do certain <br />things so we continued the hearing to January 15, 1986. Two days <br />before that, he contacted the City Attorney and was very angry and <br />said he had sold his property, and that he was going to get even with <br />the City. Since Welsh sold his property and will be leaving by March <br />I, 1986, the City Attorney continued the court date to March 2, 1986. <br />Ecor, Marketing wanted us to pursue the prosecution even though Welsh <br />is leaving. I believe the City's interest is to get the property in <br />cor~formance with the City Code - not to prosecute in order to punish. <br />All parties are now upset at the City and the City Attorney. Perhaps <br />this is a good result. <br /> <br />Council Action: <br /> <br />Your action will be to discuss with Staff and the City Attorney and <br />determine if this was properly or improperly handled and direct any <br />differer, t policy as you deem appropriate. <br /> <br /> <br />
