Motion by Councilmenber Schlueter and seoonded by Comcilme~ber Sorteberg to adopt Findings of Fact relating to Ms. Kathleen K~pf's request for a oonditional use permit to operate a folk art instruction business frc~ her home. (Please refer to findings of fact file for Findings of Fact). Motion carried. Voting Yes: Mayor Beitman, Councilmembers Sorteberg, Beimann and Schlueter. Voting No: Councilmember (bx. Motion by Councilmenber $chlueter and seoonded by Councilme~ber Reimann, for discussion, to approve Ms. Kathleen Ke~pf's request for a oonditional use permit to operate a folk art instruction business from her home oontingent upon Ms. Kempf entering into a oonditional use permit agreement with the City. Further Discussion: Councilmenber Reimann stated that b0me occupation p~rmit agreenents should require a bond or letter of credit being provided. Councilmember Reimann inquired as to the parking facilities. Mr. Kempf stated that the maximum number of students that would be present at any given t/me is 6 and with respect to parking, he has a 180' double wide driveway. Councilmember Cox inquired if there is adequate water supply and sewer facilities at the site. Mr. K~pf replied that he has 600 square feet of drainfield. Councilmenber Cox inquired if Mr. K~npf would be willing to waive his homestead tax credit rights because of the business. Mr. Kemp replied that in this case, the only part of the home that can be oonsidered tax deductible is less than 1%; the profit fr~m this business is projected to be $5,000/year and therefore cannot afford to rent (x~mmer~al property. Mr. Kempf also noted that this is a lc~ traffic flew business. Gouncilmomher Cox stated that the $5,000 profit is taken away from a business owner paying to be in a o0~nercial zone. Councilmember COx noted that in the past Mr. Ke~pf was adimant about not having commercial developed adjacent to his hc~e and now he wants cx2mmercial in his home to avoid paying the freight in a oa...ercial area and taking business away from the ocm~nercial area. Motion failed. Voting Yes: Councilmembers Sorteberg and Schlueter. Voting No: Mayor Bei~nan, Councilme~bers Reimann and COx. Mr. Kempf stated that he hopes the City searches out every business that is operating out of a home without the proper permits. e~se t14 -.
