(Please refer to findings of fact file for Findings of Fact). <br /> <br />Motion carried. Voting Yes: Mayor Beitman, Councilmembers Sorteberg, Beimann <br />and Schlueter. Voting No: Councilmember (bx. <br /> <br />Motion by Councilmenber $chlueter and seoonded by Councilme~ber Reimann, for <br />discussion, to approve Ms. Kathleen Ke~pf's request for a oonditional use <br />permit to operate a folk art instruction business from her home oontingent upon <br />Ms. Kempf entering into a oonditional use permit agreement with the City. <br /> <br />Further Discussion: Councilmenber Reimann stated that b0me occupation p~rmit <br />agreenents should require a bond or letter of credit being provided. <br />Councilmember Reimann inquired as to the parking facilities. Mr. Kempf stated <br />that the maximum number of students that would be present at any given t/me is <br />6 and with respect to parking, he has a 180' double wide driveway. <br />Councilmember Cox inquired if there is adequate water supply and sewer <br />facilities at the site. Mr. K~pf replied that he has 600 square feet of <br />drainfield. Councilmenber Cox inquired if Mr. K~npf would be willing to waive <br />his homestead tax credit rights because of the business. Mr. Kemp replied that <br />in this case, the only part of the home that can be oonsidered tax deductible <br />is less than 1%; the profit fr~m this business is projected to be $5,000/year <br />and therefore cannot afford to rent (x~mmer~al property. Mr. Kempf also noted <br />that this is a lc~ traffic flew business. Gouncilmomher Cox stated that the <br />$5,000 profit is taken away from a business owner paying to be in a o0~nercial <br />zone. Councilmember COx noted that in the past Mr. Ke~pf was adimant about not <br />having commercial developed adjacent to his hc~e and now he wants cx2mmercial in <br />his home to avoid paying the freight in a oa...ercial area and taking business <br />away from the ocm~nercial area. <br /> <br />Motion failed. Voting Yes: Councilmembers Sorteberg and Schlueter. Voting <br />No: Mayor Bei~nan, Councilme~bers Reimann and COx. <br /> <br />Mr. Kempf stated that he hopes the City searches out every business that is <br />operating out of a home without the proper permits. <br /> <br />e~se t14 -.
