Further Discussion: Mayor Hei~an inquired how Ms. Skarbakka's presence or non-
presence will change what Mr. Goodrich reoommended as the appropriate
procedure. CouncJlme~ber Cox replied that it doesn't but he does have some
questions he would like answered by the applicant. Mayor }~ettman inquired if
there was someone present in the audience representing Ms. Skarbakka and there
was no reply.

Motion carried. Voting Yes: Councilm~rs Sorteberg, Schlueter, Reimann and
Cox. Voting No: Mayor Heitman.

Mayor Heitman directed City Staff to plaoe Ms. Skarbakka's request on the next
Council agenda; to request that MS. Skarbakka or her representative be present
at that meeting; and to inform MS. Skarbakka that the case will not be fabled
again based on her non-presence.

Jeff Caine, surveyor, and Mr. Dale Voltin were present.

Councilmember COx stated that Voltin's Oak ~ill Estates is a situation where a
plat is being developed at the expense of a previous plat (Menkveld's Country
Park) because the roads are constructed and paid for. Councilmember Cox
expressed serious concern with the fact that there is only one access serving
Menkveld's Country Park and Voltin's Oak ]Hill Estates

Mr. Caine stated that Mr. Volt. in will ~-'d a road easement to the east for
future access. Mr. Caine also noted that a road looping through the
development would provide additional acoesses and more parcels but the
developer has chosen not to go that route.

Mr. Raatikka stated that street and ditch profiles have not been provided.
Additional soil borings have determined that Lot 4 is adequate for an on-site
septic system.

Mr. Caine stated that the profiles will be oomplete in a couple of days.

Councilmenber Cox rec~d that a road eas~nent between Lots 3 and 4 be
provided to the south in case of future develounent.

Mr. Voltin stated that because of the oost to build a road over the drainage
ditch, he doubts the property to the south will ever be developed.

Motion by Councilmember Sorteberg and seoonded by Counci~r Reimann to
approve Mr. Voltin's request for preliminary plat approval of Voltin's Oak Bill
Estates with a varianoe for cul-de-sac length and contingent upon Mr. Voltin
complying with the terms of the City Engineer's report dated January 30, 1986
including the provision of a 66 foot wide utility easement along the north edge
of Lot 4. Further, that development of Ix)t 4 will not take place until a
southerly access is established; subdivision of Lots 1, 2 and 3 will not be
made until an additional access has been established.

Motion carried.
