Under the requirements of the City Charter, Section <br />210.01.5, Subdivision 5 of Ordinance #84-8 and Minnesota Statutes <br />429, a public hearing must be held prior to proceeding with the <br />project. Also, one of the financing alternatives for the storm <br />sewer in the City's Industrial Area, as outlined in the feasibility, <br />is a taxing district. <br /> <br />Since the City is in the process of establishing a taxing district for <br />the West Drainage District, the City Staff has also prepared a draft <br />ordinance for the estm_blishment of the South-Central Taxing District. <br />7his ordinance is contained in enclosure (4). By adopting this <br />ordinance, the City Council will have the authority to acquire, <br />construct, reconstruct, extend, maintain and improve storm sewer <br />systems within the district. ~he cost of the improvements can be <br />recovered by levying taxes on all taxable property within the <br />di str Jct. <br /> <br />Gbservations: <br /> <br />~he timetable for the project in order to sell bonds prior to the <br />proposed effective date of }{ouse Rule 3838 is very critical. By <br />establishing a date for the t~o proposed hearings, the City Council <br />does not give up its authority to discontinue the project at any point <br />in the future. However, by ~ establishing these hearings, it may <br />not be possible to perform this project even though it may be the <br />wishes of the Council. <br /> <br />Rec, cmm~endation: <br /> <br />It is the reoommendation of the City Engineer and City Administrator <br />that the Council adopt the proposed resolution receiving the <br />feasibility report and calling for a public hearing for the utilities <br />(sanitary sewer and water main) for the City's Industrial Area and; <br /> <br />that the City Council pass a motion to introduce the ordinance and set <br />a public hearing date for the establishment of the South-Central <br />Drainage Taxing District. ~he City's bond counsel, Mr. Dave Kennedy, <br />has reviewed the proposed ordinance and reoommends it's adoption. <br /> <br />I <br /> <br /> <br />
