RECEIVING FEASIBILITY REPORT, C~I',T,ING FOR FdBLIC HEARING ON UTILITIES FOR 7~tE CITY'S INTI3S~ AREA AND (iKLLING FOR I~JBLIC HEARING ON ~tE ES~I~BLISHMENT OF ~dE SCU~-CENIRAL ~XING DISTt{ICT By: Dave Hartley, City Administrator Pete Raatikka, City Engineer Background: At the February 25, 1986 City Council meeting, the City Council adopted a resolution ordering a feasibility study for storm sewer and utilities for the City's Industrial Area. A coFs; of the feasibility study will be available at the March 25, 1986 Council meeting, as well as the proposed resolution for your ~onsideration. Under the requirements of the City Charter, Section 210.01.5, Subdivision 5 of Ordinance #84-8 and Minnesota Statutes 429, a public hearing must be held prior to proceeding with the project. Also, one of the financing alternatives for the storm sewer in the City's Industrial Area, as outlined in the feasibility, is a taxing district. Since the City is in the process of establishing a taxing district for the West Drainage District, the City Staff has also prepared a draft ordinance for the estm_blishment of the South-Central Taxing District. 7his ordinance is contained in enclosure (4). By adopting this ordinance, the City Council will have the authority to acquire, construct, reconstruct, extend, maintain and improve storm sewer systems within the district. ~he cost of the improvements can be recovered by levying taxes on all taxable property within the di str Jct. Gbservations: ~he timetable for the project in order to sell bonds prior to the proposed effective date of }{ouse Rule 3838 is very critical. By establishing a date for the t~o proposed hearings, the City Council does not give up its authority to discontinue the project at any point in the future. However, by ~ establishing these hearings, it may not be possible to perform this project even though it may be the wishes of the Council. Rec, cmm~endation: It is the reoommendation of the City Engineer and City Administrator that the Council adopt the proposed resolution receiving the feasibility report and calling for a public hearing for the utilities (sanitary sewer and water main) for the City's Industrial Area and; that the City Council pass a motion to introduce the ordinance and set a public hearing date for the establishment of the South-Central Drainage Taxing District. ~he City's bond counsel, Mr. Dave Kennedy, has reviewed the proposed ordinance and reoommends it's adoption.
