Harvey Hoover, hereinafter referred to as 'Applicant,' has <br />properly applied for a oonditional use permit to operate an automobile sales <br />and repair business in the I-1 tndustrt~ district. <br /> <br />2. ~hat t3~e Applicant appeared before the Planning Commission for a public <br />bearing pursuant to City Code on March 19, 1986 and that said public hearing <br />was properly advertised and minutes of that public hearing are hereby <br />inoorporated b~ referenoe. <br /> <br />3. ~hat the property which is the subject of the application is located at <br />7~1~ Highway 10 N.W. and is legally described as follows: <br /> <br />Andttors Subdivision No. 31, hnoka County, Minnesota: Part of bdt 5, <br />Auditors Subdivision No. 31, that part of the Southwest Quarter of the <br />Southwest Quarter of Section 27, ~twnship 32, ltange 25 and the Northwest <br />Quarter of the Northwest Quarter of Section 34, Township 32, Range 25 <br />described as follows: Beginning at the point in intersection of the <br />Northeasterly right-of-way line of O.S. Trunk Bighway NO. 10 and a line <br />parallel with and distant 511.5 feet east of the west line of the <br />Southwest Quarter of the Southwest Quarter of Section 27, Township 32, <br />Range 25; then north and parallel with said west line of said Southwest <br />Quarter of the Southwest Quarter of Section 27, Township 32, Range 25 a <br />distance of 147.58 feet; then south psrallel with said west line of said <br />Southwest Quarter of the Southwest Quarter a distance of 147.58 feet to <br />the northeasterly right-of-way line of said Highway 10; then northwesterly <br />along the said Bighway 10 a distance of 147.58 feet to the point of <br />beginning. Subject to easements of record in favor of Anoka Electric <br />Cooperative. ~his description is approximately the westerly 147.58 feet <br />of Lot 5, Auditors Subdivision No. 31 and a part of unplatted land in the <br />Southwest Quarter of the Southwest Quarter of Section 27, T~wnship 32, <br />Range 25. <br /> <br />4. ~hat the subject parcel is approximately one-half (1/2) acre in size and is <br />located in the I-1 industrial district. <br /> <br />5. ~hat the Standards for Consideration are as follows: <br /> <br />a. ~hat the property is zoned I-1 and an automobile sales and repair <br /> business is not a permitted use in this zone; <br /> <br />b. ~hat the adjoining property is zoned I-1 industrial; <br /> <br />c. ~hat there are other similar uses in the I-1 industrial district; <br /> <br />d. ~hat there would be no significant change in the traffic flow to the <br /> area; and <br /> <br />ee <br /> <br />~hat the proposed use will not be detrimental to persons working in the <br />vicinity of the use or the general lm~lic and will not substantially <br />impair the enjoyment or value of properties in the area. <br /> <br />1 <br /> <br /> <br />
