CONTRACT FOR FIRE PROTECTION <br /> <br /> Tills agreement made and entered into by and between tile City of EI~ River, <br />a municipal corporation of the County of Sherburne and State of Mlnnesma, <br />hereinafter called tile CITY, and the CITY of RAMSEY of the C-usry <br />of ANOKA and State o! Htnilesota, hereinafter called RAHSEY . <br /> <br /> WHEREAS, RAHSI';Y desires the services of the fire departmel of the <br />CITY in case of fires occurring in the CITY of RA~I.~F.Y , located <br />outst, de tl~t, corporate limits of the C1TY, and <br /> <br /> WHEREAS, the CITY nhatntatns a fire department consisting of volun~er flremen, <br />at least one (1) pumping engine and miscellaneous other equipment, whi~ personnel <br />and equipment are available, subject only to the limitations herein ex~essed, for <br />fighting fires tn said Ramsey and elsewhere. <br /> <br />IT IS THEREFORE AGREED BY AND BETWEEN SAID PARTIES AS FOLLOWS: <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> 1. That the CITY through its fire department will answer calls tefight fires <br />occurring in the City of Ramsey in the area desi~ated on <br />Schedule A with at least one (1) pumping engine and equipment to deliv~ at least <br />1,500 gallons of water and such volunteer firemen as may be designated ~ the Chief <br />of the Elk River Fire Department, or his Deputy, unless in the judgeme~ of said <br />Chief, or Deputy, such fire can be fought with other equipment matntaim~d by the <br />CITY as part of its fire department, subject only to the limitations aM restrictions <br />hereinafter set forth: <br /> <br />a. If road and weather conditions at the time of the call be~uch that the <br />fire run cannot be made with reasonable safety to men and equtlment, and the <br />decision of the Fire Chief or his Deputy in charge shall be ftml in such <br />matter, no obligation arises under this agreement on the partof the CITY <br />to answer such call. <br /> <br />b. In the event that a sufficient amount of the fire fightingequipment <br />and number of volunteer firemen, or both, are committed at thetime of the <br />fire call, in the sole Judgement of the Chief or his Deputy, m fighting <br />pre-existing fire, so as to render the available fire fightingequipment <br />and volunteer firemen inadequate to answer the fire call, in Rams~. <br />and fight the reported fire, no obligation arises unde~ this alr~ement to <br />answer such call, and no person or party shall have recourse alminst the <br />CITY for refusal to answer such call. A pre-existing fire forthe purposes <br />of this agreement shall be a fire to which the Fire Departmentof the CITY <br />is called previous to receiving the call from Ramsey andwhich fire <br />is still being fought by the City Fire Department at the time ~e call from <br /> Ramsey is received. <br /> <br />c. In the event a fire call by Ramsey is answered by~e CITY, but <br />before the fire in question is extinguished the fire fighting~uipment or <br />volunteer firemen, or both are needed to fight a fire in the (~rY or protect <br />property ~n the CITY from a fire in the sole judgement of the ~ief or his <br />Deputy without liability therefore to any person or to Racy under <br />this agreement. <br /> <br />d. The decision of the Fire Chief or his Deputy will referen~to sending <br />or recalling fire fighting equipment and volunteer firemen to ~ from any <br />fire in Ramsey shall be final and no person or paXy shall have <br />recourse against the CITY for any damages or losses resulting~om such <br />action or decision. <br /> <br />e.
