CITY OF KAMSEY <br /> DEYELOPMENI AGILEEME~? <br />¥0L?I~'8 OAK RILL <br /> <br />This contract entered into this da7 of , 1986, between <br />the City of ILamme7, hereinafter referred to as "City," and Mr. Dale ¥oltin, <br />hereinafter referred to as "Developer," in conjunction with plat approval of <br />¥oltin's Oak Hill Estates. <br /> <br />The plat of ¥oltin's Oak Rill Estates is hereby granted approval contingent <br />upon the Developer agreeing to and complying with the following conditions; <br /> <br />1. The approval of Voltin's Oak Rill Estates shall apply to that property <br /> legally described as follows: <br /> <br />The Southwest Quarter of the Northwest Quarter of Section 1~, Township <br />32, Range 25, Anoks County, Minnesota, except the north 15 feet of the <br />east 187 feet thereof, as measured along the east and north lines <br />respectively. <br /> <br />The Developer shall be responsible for the construction of <br />improvements as shown on the final plat and as directed by the City <br />Engineer, in accordance with City standards and specifications. ~"nese <br />improvements shall include, but are not limited to, streets, ditches, <br />backsloping and <br />drainage easements. The Developer shall be responsible for any <br />expense associated with the construction of these improvements. All <br />improvements shall be constructed in accordance with the <br />specifications of the City Engineer, as specified in the City Code. <br />Pursuant to this guarantee, the Developer shall post security in the <br />amount of $ which amount represents 125Z of the estimated <br />cost of constructing the improvements as determined by the City <br />Engineer. Said security shall be in the form of a letter of credit or <br />cash escrow deposited with the City. Said improvements-shall be <br />completed on or before October 1, 1987. <br /> <br />3. The Developer shall restore all disturbed areas on the site as <br /> specified by the City Engineer. <br /> <br />4. The Developer shall comply with all applicable requirements of the <br /> City Code regarding subdivisions and construction of improvements. <br /> <br />5. This development agreement shall be recorded as part of the <br /> Developer's deed. <br /> <br />6. The Developer is granted a variance for the length of the cul-de-sac <br /> on Uranium Street N.W. <br /> <br />7. The Developer shall provide to the City a 66 foot wide utility <br /> easement along the north end of Lot 4 in the Plat. <br /> <br />8. There shall be no further subdivision of Lots 1, 2, 3, or 4 in the <br /> Plat until such time as additional access is available to those lots. <br /> <br /> <br />
