~HEREASs the development plan is not iu conflict with the ~a~sey <br />Comprehensive Plan, is designed to form a unified development within tbs <br />boundaries of the property, will not create an excessive burden on public <br />facilities which will serve the development, vii1 not be detrimental to <br />neighboring properties and in general, viii be in the public interest; &nd <br /> <br /> WHEREAS, on March 19, 1986, the City's Planning and Zoning Commission held <br />a public hearing on the application for the P.U.D. and rezoning which public <br />hearing was properly published in the City's legal newspaper pursuant to City <br />Code; and <br /> <br /> WHEREAS, the City's Planning and Zoning Commission met ou March 19, 1986 <br />at which time it reviewed the P.U.D. application and made a written <br />recommendation to the City Council that the preliminary development plan for <br />the P.U,D. be approved; and <br /> <br /> WHEREAS, on March 25, 1986, the City Council granted approval to the <br />preliminary development plan for the P.U.D. contingent upon the developer <br />revising access to the site as necessary to meet the requirements of the <br />Minnesota Department of Transportation and the Aaoka County Engineer; and <br /> <br /> WHEREAS, the entire P.U.D. shall be subject to restrictive covenants and <br />conditions in order to maintain the appearance of the development. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That final approval of the River's Bend Plaza Planned Unit Development <br /> is hereby granted subject to the following: <br /> <br />That River's Bend Properties and the City enter into a <br />comprehensive development agrement which agreement shall <br />incorporate all City Code requirements, policies and restrictive <br />covenants relating to a development of this nature; and <br /> <br />That River's Bend Properties shall comply with each items <br />contained in the City Engineer's letter dated May 27, 1986 and <br />addressed to the Mayor and City Council; and <br /> <br />c. That the City of Ramsey receive proof of marketable title for the <br /> property; and <br /> <br />That the plat may not be filed until the P.U.D. zoning ordinance <br />is effective. The Developers are advised that any on-site <br />improvements constructed prior to filing of the plat will be made <br />at their risk; and <br /> <br />That if access to the plat is from State Highway ~47, River's Bend <br />Properties shall be responsible for the construction of additional <br />turn lanes as required. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Councilmember and upon vote being taken thereon, the following voted <br />in favor thereof: <br /> <br />-2 - <br /> <br /> <br />
