~uv Sylvester for a conditional use permit to establish and operate a c~metery at 5?30 179th Lane NW, contingent upon the applicant: 1) ~nt~rinE into a conditional use pe~it agreement vith ~he City; 2) City Attorney dete~inatioa that State and local regulations regarding construction, operation and perpetual ~aiutenance of a cemetery have been c~pleted and are in place. Further, that said pe~it viii becks null and void in the event the develo~ent agreement is not satisfactorily c~pleted ~ithin tvo years. Motion carried. Voting Yes: Mayor Heitman, Councilmembers 8orteberg, Cox, Reimann and 8chlueter. Voting No: ~one. Marion Grens - Inquired as to vhat the City intends to do about Trott Brook Cemetery; vi11 it be moved in time for Memorial Day? Notion by Councilmember Cox and seconded by Council~ember Reimann authorizing that Trott Brook Cemetery be mowed prior to gemorial. Further Discussion: Councilmember Cox stated it vould be appropriate for Council to take a stand on the cemetery issue for the benefit of the Cemetery Committee. Councilmember Reimann stated that the Cemetery Committee should make a recommendation to City Council regarding ~aintenance of existing cemeteries and Council ~ill determine if the City budget can absorb those costs. Mayor Heitman stated that Councilmember Cox should also resurrect prior recommendations he says vere ignored and the Committee vi11 have a conclusion at that point in time. A1Koenig inquired if there are City funds available for cemetery maintenance. Hayor Heitman replied that there are no funds designated in the budget for cemetery maintenance. Councilmember Cox stated that the City does have additional funds available and it is the City*s responsibility to maintain these cemeteries. Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, Cox, Reimann and Schlueter. Voting No: None. Motion by Councilmember Reimann and seconded by Councilmember Cox to adjourn the meeting. Further Discussion: Mayor Heitman stated that the hour is late but Mr. Robert Cox (Case ~19) and Mr. I)ubats (Case ~17) have been vaiting to have their cases addressed. Councilmember Relmann stated that Case ~17 and Case ~19 can be placed on the April 29 agenda. Motion carried. Voting Yes: Councilmembers Sorteberg, Cox and Reimann.
