5 Minutes CASE f2: <br /> <br />REQUEST FOR CONDITIONAL USE PEP, HIT TO OPERATE TLVLEPEONE AND <br /> CATALOC SALES AND RgPAIR SERVICE FOR FIREARMS FlOM ROME; <br /> CASE OF MR. JANES ROBERTS <br /> By: Anus Norris, Community Development Director <br /> <br />Background: <br /> <br />Mr. James Roberts is requesting a conditional use permit to operate a repair <br />and sales (telephone and catalog) of firearms business from his home at 7/,41 - <br />164th Lane MW. Mr. Roberts has stated that he would not stock firearms or <br />ammunition on his premises; the only firearms or ammunition that Mr, Roberts <br />would have are those that have been ordered and haws come in and not been <br />picked up or those firearms that are in for repair. Mr. Roberts has stated <br />that be has adequate off-street parking available. Mr, Roberts also stated <br />that he has obtained a Federal firearms license required for sale of firearms. <br />Mr. Roberts stated that there would be no test firing of firearms from the <br />premises. Mr. Roberts also stated that there would be a maximum of 2-3 <br />customers per week coming to his home. <br /> <br />The Chief of Police has reviewed Hr. Roberts' application and stated that as <br />long as Mr. Roberts will not be stocking firearms in his home, the proposed use <br />should not create a problem. In addition, the applicant and Chief have <br />discussed the appropriate procedure for selling firearms only to those <br />individuals who have obtained a permit for firearms. <br /> <br />Staff received a letter dated April 24, 1986 from Todd and Judy Cheslock <br />opposing Mr. Roberts' request based on their concerns regarding increased <br />traffic in the area. Staff also received a letter dated Nay 5, 1986 from Mark <br />and Bonnie Hagemann stating that they had no objections to Mr. Roberts' <br />request. <br /> <br />The Planning and Zoning Co~mission conducted a public hearing on Mr. Roberts' <br />request on May 6, 1986. <br /> <br />Included in the reference material are the following for your information: <br /> <br />a) Application <br />b) Site location map <br />c) Public hearing notice <br />d) Properties notified <br /> e) Letter dated April 29, 1986 from Todd and Judy Cb.lock <br /> f) Letter dated May 5, 1986 from Hark and Bonnie ~agemann <br /> g) Proposed findings of fact <br /> h) Proposed conditional use permit agreement <br /> <br />Observations: <br /> <br />As the applicant will not be stocking firearms at his home, and sales will be <br />by mail or telephone and will not create a significant increase in traffic to <br />the area, the Planning and Zoning Commission recommended that Mr. Roberts' <br />request be approved. <br /> <br /> <br />
