the Brookfield 7th Addition and homes would begin construction shortly. He thanked staff for <br /> providing the Commission with a thorough staff report and noted this was a challenging piece of <br /> land. He believed that this parcel would create beautiful lots and was worth the extra effort. He <br /> appreciated staff's efforts to ensure sheds and decks could be built on the lots and then reviewed <br /> how his homes would fit on the proposed lots. He believed that shallower homes would fit on <br /> the smaller lots and requested no lots be lost within the plan. <br /> Community Development Director Gladhill asked if the development would have an HOA. <br /> Mr. Bona did not anticipate the development would have an HOA but would have covenants in <br /> place with the County. <br /> Commissioner Bauer questioned if the two lots in question could have a condition in place to <br /> require the homes not be more than 36 feet deep. <br /> Community Development Director Gladhill did not support this approach. He did not support <br /> covenants driving City policy and recommended the Planning Commission not proceed in this <br /> manner. He discussed the City's Ordinance in further detail noting staff understood that lots may <br /> be lost but in the end wetlands would be protected. <br /> Mr. Bona stated the two lots in question were very valuable, critical even, which led him to <br /> continue fighting for these lots. He recommended the City's Ordinance be tweaked and that he <br /> be allowed to have the lots requested. <br /> Motion by Commissioner Bauer, seconded by Commissioner Andrusko, to close the public <br /> hearing. <br /> Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, Andrusko, Brauer, <br /> Nosan, and VanScoy. Voting No: None. Absent: None. <br /> Chairperson Levine closed the public hearing closed at 8:12 p.m. <br /> Commission Business <br /> Commissioner Bauer requested further comment from staff on what was approvals were being <br /> asked of the Commission. <br /> City Planner Anderson reviewed each of the requests in detail with the Commission noting the <br /> applicant was seeking approval of variances for front yard and side corner setbacks, cul-de-sac <br /> length and lot depth standards, in addition to a Comprehensive Plan Amendment and Preliminary <br /> Plat approval. <br /> Community Development Director Gladhill requested the Commission address the <br /> Comprehensive Plan Amendment first. <br /> Planning Commission/October 6, 2016 <br /> Page 6 of 13 <br />
