Commissioner Bauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-10-181 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0968 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE FRONT YARD AND SIDE CORNER SETBACK <br />WHEREAS, Brookfield Land, LLC, hereinafter referred to as "Applicant", properly <br />applied to the City of Ramsey (the "City") for a variance from the minimum front yard setback <br />length prescribed in Section 117-111, Subd. (d) on portions of the property legally described as <br />follows: <br />Outlot A, Brookfield 2nd Addition <br />Or upon platting and recording: <br />Lots 1-9 (inclusive) Block 1, and Lots 15-16 Block 2, Brookfield 8th Addition, Anoka <br />County, Minnesota <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY PLANNING <br />COMMISSION, as follows: <br />1) That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 117-53 (Variances) of the Ramsey City Code on October 6, 2016, and that said <br />public hearing was properly advertised, and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br />2) That the Subject Property is zoned R-1 Residential (MUSA). <br />3) That the surrounding properties to the north and east are also zoned R-1 Residential <br />(MUSA), while the properties to the south and west are zoned R-1 Residential (Rural <br />Developing). <br />4) That Section 117-111 Subd. (d)(3) of City Code requires a front yard and side corner <br />setback of thirty (30) feet. <br />That there are wetlands and/or stormwater ponds in the rear yards of the Subject Property <br />limiting the amount of usable/buildable space. <br />6) That a similar variance was approved for another subdivision in which all the yards backed <br />up to a stormwater pond or wetlands. <br />
