7) That in May of 2016, the City adopted an ordinance amendment that established a <br />minimum lot depth standard to ensure more usable/buildable space in rear yards of newly <br />created lots (this new standard does apply to the Subject Property). <br />8) That a reduced front yard setback should help limit the number of potential encroachment <br />issues and possible wetland fill violations on the Subject Property. <br />9) That the proposed twenty-five (25) foot front yard and side corner setback is in harmony <br />with other parcels within the Brookfield subdivision properties and consistent with the <br />Comprehensive Plan land use guidance of Low Density Residential. <br />10) That economic circumstances alone do not create the practical difficulties. <br />11) That the plight is not due to circumstances unique to the Subject Property. <br />12) That the plight is not created by the Applicant. <br />13) That, if granted, the variance will not alter the locality's essential character. <br />14) That, if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br />15) That, if granted, the variance will not have the effect of allowing a use that is prohibited in <br />the applicable zoning district. <br />16) That, if granted, the variance will not unreasonably increase the congestion on the public <br />street. <br />17) That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br />18) That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br />19) That, if granted, the variance requested is the minimum variance necessary to accomplish <br />the intended purpose of the Applicant. <br />20) That, if granted, the variance will not grant the Applicant any special privilege that is <br />denied to the owners of other land in the same district. <br />Resolution #16-10-181 <br />Page 2 of 3 <br />
