not be development for a certain period of time, and the easement would just be used for a <br />driveway for the time being. <br /> <br />Councihnember Cook stated he would like to see the Council go ahead with his motion, and <br />agreements relating to the easement would have to be worked out with the property owners. Mr. <br />Bauer would have to develop his property for the City to want to put a road through there. <br /> <br />Mr. Bauer replied that is possible, and people do not need to think that as soon as this were to <br />happen there would be an expectation of a road running through there. <br /> <br />Cotmcihnember Cook indicated if the City went through with this action they could negotiate <br />something with Mr. Bauer financially for having the driveway there, but that would be separate <br />fi'om this. <br /> <br />Councihnember Pearson asked how large Mr. Bauer's parcel is, and how much is buildable. <br />Mr. Bauer replied the entire subdivision is just over 13 acres. There is wetland on the property <br />and there was delineation done. There would be about seven buildable acres at the most. The <br />ghost plot is accurate as to what lots there could be, but it is not accurate as to what is the <br />buildable property. He noted to develop the property; City sewer and water would be needed. <br /> <br />Ms. Kaas questioned when Mr. Bauer might develop the property. <br /> <br />Mr. Bauer replied at this time, as far as he knows there is no expectation for City sewer and <br />water. At this time he does not plan on developing it at all. <br /> <br />Mr. Dusbabek stated his position would be if the City looks at purchasing the easement it sounds <br />like they can put conditions in there about future development. The easement would not be <br />utilized until there was a need for it, other than possibly cursory grading for the driveway <br />purpose. Once there is City sewer and water available the easement would be opened up if the <br />land is developed further. His position is that if that were to take place the developer would bear <br />the costs of putting those assessments in. <br /> <br />Mayor Gamcc commented the driveway would remain as a gravel road until there was to be any <br />further development that would take place. <br /> <br />Councihnen~ber Zimmerman stated Mr. Dusbabek is willing to sell an easement to Mr. Bauer, <br />but the Kaas party is not. He does not think he would be in favor of condemning one person's <br />land for the sake of someone else. <br /> <br />Mr. Dusbabek stated he does not want more trees coming down. He would be willing to sell to <br />the City, but not a private party; that is the only way to do this in a timely time flame to keep the <br />road from coming in behind him and impacting him further. If Mr. Bauer is forced to put the <br />road in through the north, he would not have an interest in selling that easement. <br /> <br />City Council/July 27, 2004 <br />Page 14 of 35 <br /> <br /> <br />
