Mrs. Kaas stated it is being said that there needs to be a road easement, but Mr. Bauer is saying <br />the land may never be developed. <br /> <br />Councilmember Cook replied the City cannot go by Mr. Bauer's opinions, as he may not even be <br />a resident there in five years. They need to correct this problem now, and they also need <br />east/west routes in the City. If they do not take care of this it will cause a problem in the future. <br /> <br />Mrs. Kaas stated as far as this being an east/west route, almost everything behind them is <br />wetlands. <br /> <br />Councihnember Strommen questioned why the City would have purchased an easement past <br />their property. <br /> <br />Assistant Public Works Director Olson replied if there would have been a subdivision request the <br />easement would have been required as part of their property. The platting is done that way; they <br />try not to let this happen in the platting process. <br /> <br />Councihnember Strommen noted there may be more situations like this in older subdivisions all <br />over the City. <br /> <br />Councihnember Elvig indicated he abstained from this previously because Greg Bauer is his <br />brother-in-law. He noted when they plotted Mr. Bauer's property, a stipulation was placed on <br />Mr. Bauer that he grant and gift an easement going east/west across this property. This Council <br />decided that was a good idea, and they are now saying they would never do that and why would <br />they consider going east/west. That was a stipulation for Mr. Bauer to have his house plotted on <br />his property. <br /> <br />Councihnember Kurak inquired if there is a possibility of the road going across east/west on the <br />north side. <br /> <br />Assistant Public Works Director replied it would cross wetlands. There would be impact to <br />wetlands if the road is built at either 161st or 160th. <br /> <br />Councihnember Kurak stated that is private property owned by these individuals. The City <br />caused this damage, but it does not give them the right to go back and say they are going to take <br />the property now. That goes against every grain she stands for. The Council is being asked to <br />buy an easement for one house, but there is available access to this parcel from the north; it is not <br />landlocked. <br /> <br />Mayor Gamec commented if the driveway goes in from the north Mr. Dusbabek will lose a lot of <br />property. <br /> <br />Councilmember Kurak stated Mr. Bauer could purchase a driveway parcel. It is inappropriate to <br />purchase the easement. There is not an easement there now, and to assume now there will be <br />because the City caused damage is wrong. <br /> <br />City Council/July 27, 2004 <br />Page 15 of 35 <br /> <br /> <br />
