Mi'. McDonald explained with smaller convenience stores the gas sales are more at a ratio of 85 <br />percent of the overall business. He indicated there is also a concern with the restriction on fast <br />food operations. He requested a definition of what fast food is, as it has always been the <br />intention of the grocer to have a deli. <br /> <br />Assistant Community Development Director Trudgeon replied the intent is to restrict fast food <br />type fral~chised restaurants. The requirement can be changed to reflect this. <br /> <br />Mr. McDonald requested the last requirement be changed to state 3 islands, 6 dispensers. <br /> <br />Assistant Community Development Director Trudgeon replied this would be acceptable to staff. <br /> <br />Mr. McDonald expressed concern with the requirements concerning well head protection. <br /> <br />Assistant Public Works Director Olson advised these requirements should be included in this <br />zoning district, as well as in Case #17. <br /> <br />Assistant Community Development Director Trudgeon explained the whole Town Center area is <br />in a well head protection area. The requirements are to prevent any contamination. <br /> <br />Councihnember Cook asked ifTC-2 is the only area that would be allowed to have gas or if these <br />requirements would be needed in the entire Town Center area. <br /> <br />Assistant Community Development Director Trudgeon replied the requirements would only be <br />needed in the TC-2 District. <br /> <br />Mr. McDonald stated the concern is that some of these requirements are very restrictive and very <br />expensive. There is a point to be made that anything that will be done comes with state and <br />fcderal regulations. These requirements are over and above those regulations. All of these <br />requirements arc about $115,000 to $200,000 above and beyond the cost of a normal installation, <br />and there should be a little room left open for a bit of negotiation. He asked if there are still <br />negotiations occurring as to whether the well should be relocated. <br /> <br />Assistant Community Development Director Olson stated the need for these types of <br />improvements are as protection to be sure the municipal water supply does not have any <br />contamination. There is potential to move the well. The test pumping turned out better than he <br />had previously suggested, and there is actually more vibration in Well House 3 than in the <br />training well. He stated they need to get moving on this construction. He would be willing to <br />negotiate these requirements, but they are trying to go above and beyond what the state requires <br />as a minimuln because they want additional protection for the municipal water supply. <br /> <br />Mr. McDonald commented some of these requirements may be prudent, but all of them may be a <br />little bit overboard. <br /> <br />City Council/July 27, 2004 <br />Page 25 of 35 <br /> <br /> <br />
