PROPOSED FINDINGS OF FACT Om <br /> STEVE SIHONS <br /> <br />1. That Mr. Steve Simons, hereinafter referred to "Applicant", has <br />properly applied for a conditional use permit to operate an automobile <br />sales business in the I-1 Industrial District. <br /> <br />2. The Applicant appeared before the Planning and Zoning Commission for a <br />public hearing pursuant to Section 170.013D of the City Code on November 5, <br />1986 and said public hearing was properly advertised and minutes of that <br />public hearing are hereby incorporated by reference. <br /> <br />3. That the property which is the subject of the application is located at <br />7205 - 7210 Hwy. #10 N.W. and is legally described as follows: <br /> <br />Lot 7, Auditor's Subdivision No. 34, Anoka County, Minnesota (Except <br />~3600)(Except ~3700)(Except ~3565)(Except #3620)(Except ~3630)(F. xcept <br />~3570)(Except ~3550)(Except ~3505) <br /> <br />-and- <br /> <br />That part of Lot 7, Anditor's Subdivision No. 34, being a part of Section <br />28, Township 32, Range 25, Anoka County, Minnesota, described as follows: <br />Commencing at the Southeast corner of said Lot 7, thence North 0 degrees 3 <br />minutes 28 seconds East along the East line of Lot 7, Auditor's <br />Subdivision No. 34, 367.87 feet to the point of beginning from a line <br />hereinafter referred to as Line "A"; thence Southwesterly to a point on <br />the Southwesterly line of Lot 7, 111.9 feet Northwesterly as measured <br />along the Southwesterly linsaid Lot 7 from the pont of beginning and to <br />the termination of Line "A"; thence Northwesterly on the Southwesterly <br />line of said Lot 7, 658.1 feet; thence North and parallel with the East <br />line of said Lot 7 and to the Northeasterly line of said Lot 7; thence <br />Southeasterly on said Northeasterly line a distance of 350 feet; thence <br />South and parallel with the East line of said Lot 7 and to the <br />Southwesterly line of said Lot 7; thence Southeasterly on said <br />Southwesterly line a distance of 180 feet to the point of beginning of <br />land to be herein described; thence North and parallel with the East line <br />of said Lot 7 and to the Northeasterly line of said Lot 7; thence <br />Southeasterly on said Northeasterly line 107.14 feet; thence South and <br />parallel with the East line of said Lot 7 a distance of 177.43 feet; <br />thence East and parallel with the South line of Section 28, Township 32, <br />Range 25, to the point of intersection with the aforedescribed Line "A"; <br />thence Southwesterly along the aforedescribed Line "A" to the <br />Southwesterly line of said Lot 7; thence Northwesterly on the <br />Southwesterly line of said Lot 7 to the point of beginning. <br /> <br />-and- <br /> <br />That part of the Southeast Quarter of the Southeast Quarter of Section 28, <br />Tonwship 32, Range 25, also being part of Lot 7, Auditor's Subdivision No. <br />34, Anoka County, Minnesota, as described as follows: Beginning at the <br />intersection of the Northerly right-of-way line of U.S. Highway 10 and 169 <br />and the East line of said section, also being the Southeast corner of said <br />Lot 7; thence Northerly along the said East line of said Section 367.87 <br />feet; thence Southwesterly to a point on the Northerly right-of-way line <br />111.9 feet Northwesterly measured along said right-of-way line from the <br />point of beginning; thence Southeasterly along said right-of-way line to <br />the point of beginning. Except the East 33 feet taken for County Highway <br />56 and that part of the Southeast Quarter of the Southeast Quarter of <br />Section 28, Township 32, Range 25, also being part of Lot 7, Auditor's <br /> <br /> <br />
